Thank you for your request for information on why nationals of Malta and
Cyprus are not subject to the Worker Registration Scheme.
The reason for this is not to be found in UK legislation but in the terms
on which Malta and Cyprus acceded to the European Union. While the Treaty
on Accession provided for transitional measures on labour market access to
be applied by the existing Member States to nationals of the Central and
East European States joining the EU on 1 May 2004, the Treaty contained no
such provision in respect of Malta and Cyprus. Consequently there is no
legal basis on which the UK could subject nationals of Malta and Cyprus to
the Worker Registration Scheme even if it wished to.
