From: Ian Stewart

Dear Sir or Madam,
Dear Sir or Madam, Is it acceptable/legal, for a permanent
exclusion of a pupil from a school to be rescinded and for the
pupil to then be removed from the school's roll and never be
allowed to return to that school. If so, how long is the deadline
for the pupil to be returned to another mainstream school?
Yours faithfully,
Ian Stewart

Cambridgeshire County Council

Dear Mr Stewart
Thank you for your enquiry.
Headteachers are the only people who can make decisions to permanently
exclude a pupil. The disciplinary committee of the school's governing body
must then hear the case to uphold or rescind the headteacher's decision;
this must happen no sooner than 6 school days after the notification of
the exclusion and no later than 15 school days after the notification.
There are precedents where headteachers have withdrawn the permanent
exclusion and considered alternatives like a managed move to another
school.
A pupil should not be taken off roll in the circumstances portrayed in
your question. There is therefore no deadline for return as it should not
happen in the first place.
I hope this answers your question satisfactorily.
If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to Helen Maneuf, Head of Audit and Information
Governance, Box RES 1405, Room 307, Shire Hall, Castle Hill, Cambridge CB3
0AP within 40 days of receiving this response.
If you are not content with the outcome of any complaint, you may apply
directly to the Information Commissioner (IC) for a decision. Generally
the IC cannot make a decision unless you have exhausted the Council's own
complaints procedure. The IC can be contacted at Wycliffe House, Water
Lane, Wilmslow, Cheshire, SK9 5AF
Yours sincerely
