Freedom of Information Request 283623

Thank you for your email below in which you requested the following information:

1. The names and number of staff seconded to the Department for Communities and Local Government during 2007 and present

2. The value of work (£) commissioned to 21C Consultancy Ltd. for eVoting pilots, as lead by SBC

3. The grounds for dismissal of Deputy Returning Officer Alan Winchcome

Your request was received on 8 August and I am dealing with it under the terms of the Freedom of Information Act 2000.

The Council has a duty to respond promptly or no later than 20 working days, which in this case is 8 September 2008. However, as in this case, if a qualified exemption applies to the information and the public interest test is engaged the Act allows the time for the response to be longer than 20 days, and the information must be supplied within what is considered a 'reasonable' time scale considering the circumstances of the case.

I can confirm that the information requested is being considered under Section 40 of the Freedom of Information Act as it contains third party personal information.

In the meantime all unaffected information will be released to you as soon as possible. It is anticipated that a full response will be sent to you within the next fourteen days.

1. The names and number of staff seconded to the Department for Communities and Local Government during 2007 to present?

I have requested a thorough search of our records and can find no evidence that any member of staff has been seconded to the department.

2. The value of work (£) commissioned to 21c Consultancy Ltd for evoting pilots, as lead by SBC?

I can confirm I have contacted the Electoral Manager and can now release the following information:

We do not have the figures for the work carried out by 21c. The pilot scheme was financed by the Ministry of Justice and the money was divided between various parties through TATA, a private company responsible for the pilot project.

Dear IC,

Further to my previous email, in which I stated we would endeavour to come to a final decision concerning your request by 17 October, I am now able to release the following information.

As you are aware, we are considering the information under Section 40 of the Freedom of Information Act, as you have requested third party personal information. As such, we have informed the third party involved and are awaiting their comments.

Although it will be the Council who has to take the final decision, until we have their opinions, we can not come to a final decision, as we have a duty of 'fairness' in these matters.

Taking these factors into account it is anticipated that that we will be able to come to a final decision by 31 October.

I can't see where the authority explicitly says so, but I assume they are trying to work out whether to release the answer to "3. The grounds for dismissal of Deputy Returning Officer Alan Winchcome"

Therefore I'm marking this as "waiting response", although there is some information.
