Under the freedom of information act 2000

Please can you provide me with the following information -

1. How many children from black/mixed race families have been
admitted to year 7 at Northampton School For Boys over the last
five years ( 2005/6/7/8/9 )

2. How many children from Asian families have been admitted to year
7 at Northampton School For Boys over the last five years (
2005/6/7/8/9 )

My original request was dated on 15/4/09 to Northampton Borough
council who have told me that it is the County Council which holds
this information.

Your help in this matter is most appericiated.

Dear Gillian Hollowell,

Regarding my Freedom of Information Act 2000 Request ( FR1278 )

I find your request for an extension to may 29th unacceptable as
this is well beyond the guidelines for a prompt response and is
also past the 20 day period which means that Northampton county
council are breaking the law according to the Freedom of
Information Act 2000 ( chapter 36 ) as laid out below -

(1)
Subject to subsections (2) and (3), a public authority must comply
with section 1(1) promptly and in any event not later than the
twentieth working day following the date of receipt.

I will be contacting my M.P. next week and forwarding all relevant
documents to this request ( FR1278 ) and also to ask him to find
out what the "delay with gathering the relevant information" was.

Looking at other requests it seems there is a problem at
Northampton County Council as you seem not to be able to give out
the requested information in the required time so if i do not
receive a satisfactory response from you then i will also be
requesting that the council holds a full internal review into it`s
procedures regarding my request.

Your refusal to agree to an extension of time for response to your request is noted. The FOI team is currently experiencing some technical problems, hence the reason for the request for an extension sent to you yesterday. We should however now be able to respond within time.

I have checked your request which was dated 16 April however as it was sent at 6.12pm this was after close of business on that day and accordingly was deemed received by the Council on 17 April 2009. As you rightly pointed out S.10 of the Freedom of Information Act 2000 requires compliance within 20 working days from the day after receipt. As your request was received on 17 April you will receive a response on or before 18 May 2009.

Dear Miss Allen,

RE: Freedom of Information Act 2000 - FR1278

Thank you for your response to my request.

I am extremely disappointed that it has taken nearly a month to be
advised that Northampton County Council do not hold or can obtain
the information I require.

I was advised several weeks ago by Northampton Local Authority that
they or the school do not hold this information and referred us to
the Northampton County council where this data is held.

I am fully aware of the admissions policy for Northampton School
for Boys. My original request was for the amount of black/mixed
heritage children and Asian children that have been admitted into
Year 7 over the last five years and not the admissions policy.

I find it hard to believe that this information is not available
from Northampton County Council as the school is within the borough
of Northampton.

Please respond to my original request.

Firstly I apologise for the fact that it has taken a month for us to
inform you we do not hold the information you requested and therefore
cannot supply it to you, and we cannot go to NSB on your behalf.

The information which you have requested regarding the admissions policy
for NSB is not held in the Authority. As a foundation school it is its
own admission authority, which is why we have requested that you go to the
school directly.

Thank you for your apology relating to the amount of time it has
taken your Department at Northampton County Council to tell me that
you do not hold the information that I requested, I am confused as
to why you needed another Two weeks for an extension as per your
request on 14th May but do appreciate that your department are
extremely busy.

As you keep sending me information for the admissions policy for
Northampton School For Boys which I have told you that I already
know I have pasted the original request that I sent to Northampton
County Council on April 16th below -

Under the freedom of information act 2000

Please can you provide me with the following information -

1. How many children from black/mixed race families have been
admitted to year 7 at Northampton School For Boys over the last
five years ( 2005/6/7/8/9 )

2. How many children from Asian families have been admitted to year
7 at Northampton School For Boys over the last five years (
2005/6/7/8/9 )

Kindly note that the information I am requesting is HOW MANY ( i.e.
number of children ) have been admitted into the school and NOT the
schools admissions policy which I have previously stated I already
know.

Please note that if I do not receive a satisfactory outcome for my
request and as the time for my request as gone way beyond the
guidelines set by law I will be requesting a full internal review
of the councils reluctance in providing the information that I have
asked you to provide me since 16th April 2009.

I will also be making a complaint to my member of parliament and
will be asking him to investigate this matter further.

Dear Mr Attfield

Northamptonshire County Council is obliged, under S.1(a) of the Freedom of
Information Act 2000 to advise you whether it holds the information you
requested and if it does under S.1(b) to supply that information to you.
The letter from Ms Allen of 15 May 2009 and my e-mail of 18 May 2009
(copies attached) both stated that Northamptonshire County Council does
not hold the information that you requested and detailed the reasons for
this.

We would like to add that our response was actually given within the
statutory timescales of the Act.

We were also well aware of what you were asking for, and merely attempting
to provide further information which might assist you

S.3 of the Act deals with the definition of a public authority and for
these purposes please note that under Schedule 1 paragraph 52 of the Act
all maintained schools (as defined by the School Standards and Framework
Act 1998 - see S.20 of that Act) are separate public authorities for the
purposes of the Freedom of Information Act 2000. This means that
Northampton School for Boys is a separate public authority for the
purposes of the Act.

Northamptonshire County Council cannot supply you with information it does
not hold. Neither is Northamptonshire County Council obliged to obtain
information it does not hold from another public authority (ie NSB) in
order to supply you with the information requested. You are however at
liberty to request the information direct from NSB, contact details have
already been provided to you.

I do therefore consider that Northamptonshire County Council has complied
with its obligations under the Freedom of Information Act 2000 and as
detailed in Ms Allen's letter of 15 May 2009, if you are not happy with
how your request has been handled you can request a review and if still
not happy can refer the matter to the Information Commissioner's Office.
However, In view of your comments and the fact that we still cannot
provide the information that you require , we will treat your last e mail
as a request for a review and have now referred this to Mr Edwards for
this purpose and will send him copies of all the correspondence.
