Dear Sir or Madam,

On 6th August 2009 I wrote to you asking for information relating
to Employment Tribunals, an extract of which is hereto attached.:-

"Please provide me with the following information in connection
with
Employment Tribunals:-

1. How many judgements have been awarded against employers when
there has been no evidence to show that the employer was the
appellants employer?

2.Please list the cases showing date, appellant, respondent, place
and Employment Judge or Tribunal Chairman."

By law under all circumstances you should have replied long before
now.

As my request is now long overdue I would like an internal review
into the matter.

Dear Mr Thorburn,

SUBJECT: Freedom of Information Request

Thank you for your correspondence of December 17, 2009, in which you
asked for information regarding Employment Tribunal judgements against
employers who were not the appellants employer under the Freedom of
Information Act 2000 (FOIA) from the Ministry of Justice (MoJ).

You will receive a response from us by January 19, 2010. Your request
has been passed to the appropriate business unit within the MoJ, and
they will write to you with their decision by this date.

The FOIA does provide a number of exemptions. A qualified exemption
requires that before relying on it we must consider the public interest
test. If the information you have requested is covered by a qualified
exemption(s) under FOIA, the Department is allowed to take longer than
20 working days to respond. This is because in such circumstances we are
required to consider the public interest issues when deciding whether or
not to disclose the information requested.

If more time is needed to consider the public interest issues under a
qualified exemption(s), we will write to you and inform you of the
revised date you can expect to receive a response to your request.

If you have any queries regarding this request please do not hesitate to

Thank you for your response. I am however disappointed that it has
taken over 140 days from my original enquiry to have something from
you. Obviously you have lost the original enquiry which is strange
as it was sent and recorded electronically.

I await your answers to my original enquiry as wwell as the results
of your internal review of what exactly happened to the lost mail.

I note you various caveats for not sending data and will only deal
with those should your reply be negative and unacceptable.
