Enforcement Action Log update

The request was successful.

Ganesh Sittampalam

Dear Information Commissioner’s Office,

You've previously provided a copy of your Enforcement Action Log with names of public authorities relating to open cases redacted except where formal action had already been taken against them. (http://www.whatdotheyknow.com/request/fo...)

I note that you have issued practice recommendations against two authorities today (UKBA and Cardiff Council). Please could you identify which entries they correspond to in the redacted spreadsheet you released in October, or alternatively if this is easier provide an up-to-date copy of this sheet. If you do decide to produce an up-to-date copy of the sheet then feel free to apply the same kinds of redactions as previously without further explanation.

Yours faithfully,

Ganesh Sittampalam

Case Reference Number IRQ0286098

Dear Mr Sittampalam

I am writing further to my acknowledgement dated 23 December 2009 and in
response to your email dated 22 December 2009. In your email you refer to
a copy of the Enforcement Action Log previously provided
([2]http://www.whatdotheyknow.com/request/fo...). Within this document the
names of public authorities relating to open cases have been redacted,
except for where formal action had already been taken. You ask us to
identify the entries within this spreadsheet that relate to the UK Borders
Agency (UKBA) and Cardiff County Council, as this office has now issued
Practice Recommendations to these authorities. This request has been dealt
with in accordance with the Freedom of Information Act 2000.

We have provided this information within the attached document. Aside from these
additions the document contains the same information as the version released to
you on 28 October 2009, and for your ease of reference we have marked the
entries relating to UKBA and Cardiff County Council in blue.

As indicated in your request, and our response to [3]IRQ0266393/
RCC0271533, the Enforcement Action Log is a working document which evolves
as cases progress and as circumstances change. In the near future, entries
for UKBA and Cardiff will be updated to reflect that a practice
recommendation has now been issued.

For completeness, the practice recommendations referred to in the initial
request can be viewed online at:

UKBA -

Cardiff County Council –
[5]http://www.ico.gov.uk/upload/documents/l...

I hope this information is helpful. If you are dissatisfied with the
response you have received and wish to request a review of our decision or
make a complaint about how your request has been handled you should write
to the Internal Compliance Team at the address below or e-mail
[6][email address]

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation. To make such an application, please write
to the Case Reception Team, at the address below or visit the
‘Complaints’ section of our website to make a Freedom of Information
Act or Environmental Information Regulations complaint online.

A copy of our review procedure is attached to this email.

Yours sincerely,

Adam Stevens

Assistant Internal Compliance Manager.

20th August 2010

Case Reference Number IRQ0286098

Dear Mr Sittampalam

I am writing further to my correspondence dated 3 August 2010 concerning
the release of a copy of the Information Commissioners Enforcement Action
Log.  As highlighted in your correspondence dated 23 July 2010 the
release of the enforcement log is to progress your complaint to the
Commissioner by way of informal resolution rather than to be treated as a
new request for information under the Freedom of Information Act 2010.

Please find attached a copy of the enforcement log.  As you are aware
this is an internal working document and therefore there has been some
changes since the time of your original request in August 2009.  However,
you will see from the attached that we have now released both the open and
closed entries and are no longer seeking to rely on Section 31 for the
previously withheld information.

It may also be of interest that the names of the authorities monitored
under the new Freedom of information regulatory action policy will be
posted on the ICO website in October and updated on a quarterly basis.

I hope this information is of some interest of assistance.

Yours sincerely

Charlotte Powell
