Thank you for your information request of 21st July 2008 under the
Freedom of Information (Scotland) Act 2002 (FOISA). Aberdeen City
Council (ACC) has completed the necessary search for the information
requested.

The following information can be supplied:

- Please find attached EHRIA dated 07/05/08.

- Please also find attached copy of an email provided to the corporate
director when budget cuts were being considered that touch on some
impact issues. This is the only recorded information.

We are unable to provide you with EHRIAs on Choices day service for
2006,2007 as this information is not held by the Council. In order to
comply with its obligations under the terms of section 17 of the Freedom
of Information (Scotland) Act 2002 (FOISA) the Council must issue an
official notice in relation to any requests for information not held by
it. I therefore enclose an Information Not Held notice. There is not an
earlier equality and human rights impact assessment that pre-dates the
decision to close the centre and, although equalities considerations
were taken into account in arriving at the final decision, they were not
written in this particular format.

We are unable to provide you with any information received on the
monitoring and reviewing effects of the closure of Choices on the users
as this information is exempt from disclosure. In order to comply with
its obligations under the terms of section 16 of the Freedom of
Information (Scotland) Act 2002 (FOISA) the Council must issue official
refusal notices in relation to any requests for which it is claiming an
exemption under the FOISA. I therefore enclose a refusal notice which
specifically refuses your request under the terms of 38(1)(b) - Personal
Information of the Freedom of Information (Scotland) Act 2002.

An applicant who is dissatisfied with the way in which Aberdeen City
Council has dealt with his/her request for information under section
1(1) of the FOISA regime, may, by virtue of section 20 of the FOISA,
require Aberdeen City Council to review its actions and/or decisions in
relation to that request.

If you wish Aberdeen City Council to review its actions and/or
decisions with respect to your request for information, you should write
to the City Archivist, Resources Management, Aberdeen City Council, Old
Town House, Broad Street, Aberdeen, AB10 1AQ. The City Archivist will
arrange for your application for review to be considered by the Review
Panel. The Review Panel will write to you informing you of its decision
not later than twenty working days after receipt of your request
requiring that a review be made. By virtue of section 21 of the FOISA,
the Review Panel will also provide you with a statement of its reasons
for arriving at the decision it has made.

Choices can you please clarify and cornfirm that these do not
exist. Therefore Is the written and printed statement in the EHRIA
of 07/05/08 on Page 13,Step 7,Section 21 proper and true:-

QUOTE "An EHRIA was carried out to pull together all the relevant
information, which was taken into account in formulating the budget
proposal".

This budget proposal was not made public until 14/02/08,so
therefore can the above statement be regarded as a falsehood.

undertaken as part of the strategic analysis process. However, these
assessments were not brought together into one EHRIA. This was an
oversight on officers part, due to the author of the report going into
premature labour 2 days after the Council meeting, and this
administrative task not being completed.

My oringinal question to you on 21 July 2008 Quote:

Your follow up reply on 22 August 2008 to this was Quote:

"We are unable to provide you with EHRIAs on Choices day service
for 2006,2007 as this information is not held by the Council. In
order to comply with its obligations under the terms of section 17

My follow up question to you on 4 September 2008 Quote:

Your recent repy of 16 October 2008 now states Quote:

"This statement is proper and true, as impact assessments were
undertaken as part of the strategic analysis process. However,
these assessments were not brought together into one EHRIA. This

this administrative task not being completed."

So are you now saying that assesments were produced prior and post
budget period outlining the Impact on the Closure of Choices
daycare,but due to a pregnancy in the office the EHRIA was never
produced and this is regarded as a foresight?

In my original question I also asked Quote: "I also wish to request
any information received on the monitoring and reviewing effects of
the closure of Choices on the users as used to correlate the above
EHRIA`s"

Can I deduce from your reply on 16 October 2008 assesments were
produced that this information and documents were withheld from my
original FOI request of 21 July 2008.Can I aslo deduce that your
repy on 22 August 2008 is in fact a falsehood.As your answer on 22
August 2008 contradicts any previous answers you gave pertaining to
my previous questions and requirements regarding the closure of the
Choices daycare services and use use of the Choices building.

I am concerned that our email correspondence is not resolving the issues from your perspective, and I feel there may be some misunderstandings in terms of timings and process etc. Please can I therefore suggest that we have a face-to-face meeting, which will hopefully help to answer all of your questions, and help identify any further information you may require?

Dear Ms Domeracki

I am writing further to your request for clarification dated 21 October 2008. The information you request was held in the refusal notice attached to our original response, the material content of which is reproduced below.

The information is being withheld under the Freedom of Information (Scotland) Act 2002. The exemption which applies to this information is section 38(1)(b) of the Freedom of Information (Scotland) Act (FOISA).

You requested "any information received on the monitoring and reviewing effects of the closure of Choices on the users as used to correlate the above EHRIA`s."

Aberdeen City Council (ACC) are of the opinion that this exemption applies because the only information on the review and monitoring effects of the closure of Choices on users is a range of information relating to those clients who were still in receipt of health and care services. This would be personal /individual and confidential to them and held in their case files. To disclose this information would breach the data protection principles.

The exemption claimed by ACC is an absolute exemption and therefore ACC is not obliged under the terms of the FOISA to provide you with the information requested.

the individuals who attended Choices daycare services should be
made accessable to them. Can you please tell me how to access this
information as I am an ex Choices member and the other ex members
of Choices are now members of Future Choices and we all wish to
access this personal information that is held on us. If you let me
know how to do this I will pass it on to the ex choices

Thank you for your email.

It has come to our attention that EHRC is meeting next week to consider matters relating to Choices. In light of this it would be inappropriate to meet with you until the EHRC's position is clear. I therefore suggest we postpone our meeting until after a decision has been taken. Once the Council has received confirmation of the EHRC's decision, I will get back in touch and we can agree appropriate next steps.

Dear Ms Tierney, Thank you for getting back to me.I feel that a
meeting is needed immaterial of the EHRC meeting.As I am Still
wanting my original FOI questions clarified.These have I feel been
side stepped by A.C.C as no precise answer has yet been given to
them.As you are now using the EHRC not to meet I can only assume
that my issues are again being side stepped and I now feel that
further action is needed to be taken.Therefore I feel I must now
take this issue up with the Scottish Information Commissioner.
