Dear Mr Walker,

Attached is our response to your Freedom of Information Request received by us on May 21st. You will see that we have concluded that, in respect of some of the information you requested, Section 2(1) of the Freedom of Information Act 2000 is engaged.

Section 2 (1) of the Freedom of Information Act 2000 states that:

Where any provision of Part II states that the duty to confirm or deny does not arise in relation to any information, the effect of the provision is that where either -
(a) the provision confers absolute exemption, or
(b) in all the circumstances of the case, the public interest in maintaining the exclusion of the duty to confirm or deny outweighs the public interest in disclosing whether the public authority holds the information,

section 1(1)(a) does not apply.

You have the right of appeal against this decision through the Council's internal complaints procedure by setting out the grounds of your appeal in writing to the corporate Freedom of Information Officer at:

I wish to appeal this as you have not issued a proper Section 17
Refusal Notice outlining the Exemptions you applying for each
question.

17 Refusal of request (1) A public authority which, in relation to
any request for information, is to any extent relying on a claim
that any provision of Part II relating to the duty to confirm or
deny is relevant to the request or on a claim that information is

1(1), give the applicant a notice which— (a) states that fact, (b)
specifies the exemption in question, and (c) states (if that would
not otherwise be apparent) why the exemption applies.

Dear Mr Walker,

Thank you for your e-mail in which you appealed against our response to your Freedom of Information request of May 21st on the grounds that a proper Refusal Notice under section 17 of the Freedom of Information Act 200 was not issued.

I have reviewed your appeal under the provisions of our internal Freedom of Information complaints procedure. I attach a copy of the procedure document for your information.

My review concluded that the e-mail that I sent you on May 22nd, was deficient in some regards as a refusal notice and that a new and more formal notice should be issued, which specified clearly that an exemption under Part II of the Act applied, and what that exemption was.

I attach a new refusal notice, and the report of my review of your appeal.

I do, of course, apologise unreservedly for the fact that the previous response was in any respect unsatisfactory.

Dear Mr Walker

Thank you for your Freedom of Information request received yesterday, May 28th, and reproduced below, the deadline for responding to which is June 25th.

This e-mail constitutes both an acknowledgement and our full response to your request.

I attach a schedule of documents relating to the handling of the request mentioned (our ref. Walker.John2(02)). This schedule itemises all information held by the Council that relate to that request.

No telephone calls were made in relation to that request, consequently no transcripts exist.

Documents 01, 01a, 06, 07.Appeal1 and 07.Appeal2, and the three MS Word documents are already available to you and so have not been included in this response.

Of the other documents listed, four comprise internal communications, in the form of e-mail threads. These are documents 02, 03, 04, and 05. Documents 02, 03, and 04 (excluding an attachment) are constituents of document 05.

Since Document 05 comprises all of these internal e-mails, and the attachment to Document 04 is withheld, Documents 02, 03, and 04 have not been supplied separately as this would be mere duplication. I attach Document 05.

Exempt information:

The documents referred to as being already available to you have been exempted.

An attachment accompanying Document 04 is exempt as constituting personal data.

Document 05 has been redacted to obscure personal data.

I attach a formal refusal notice in respect of the exempt information.
