Dear Sir or Madam,
Two years ago it was announced in the press that
"The Caltongate scheme has been awarded a grant of over £789,000 by
the Department of Trade and Industry for a special heating and
cooling system."
Has any of this grant been paid to the Caltongate developers
Mountgrange who have recently gone into administration? Or has the
grant now been withdrawn?
Where can the application for this grant, and details of the
consideration and recommendation for approval be viewed?

FoI request 09/0720 - award of grant to Mountgrange
I am writing to advise you that the time limit for responding to your
request for information which the Department received on 1st June 2009
needs to be extended.
The FOI Act obliges us to respond to requests promptly, and in any case no
later than 20 working days after receiving your request. However, when a
"qualified" exemption applies to the information and an accompanying
public interest test is engaged, the Act allows the time for response to
be longer, in which case a full response must be provided within such time
as is reasonable in all circumstances. In the case of your request, we
have not yet reached a decision on where the balance of the public
interest lies.
The specific exemption which applies in relation to your request is
section 43.
I hope to let you have a response by 9th July 2009.

FoI request 09/0720 - award of grant to Mountgrange
I am writing to confirm that the Department of Energy and Climate Change
has now completed its search for the information which you requested on 1
June 2009.
The questions you asked regarding a government grant awarded to the
Caltongate scheme for a special heating and cooling system were:
Has any of this grant been paid to the Caltongate developers Mountgrange
who have recently gone into administration? Or has the grant now been
withdrawn?
No grant money has been paid. The Energy Saving Trust has informed us that
they were recently contacted by the Administrators, Deloitte, who have
requested an extension to the grant offer expiry. This has been granted to
the end of December 2009 whilst they consider all available options for
the company and project.
Once decisions have been made within the next couple of months, they
expect to be updated with plans for the project and to review whether
these plans are still viable.
Where can the application for this grant, and details of the consideration
and recommendation for approval be viewed?
A copy of the information is enclosed. The names of certain individuals
have been redacted under Section 40 of the Freedom of Information Act
(personal information). The exemption from the duty to disclose personal
data, where to do so would breach a data protection principle, provided by
part 2 of section 40 of the Act (Personal Information of Third Parties),
is an absolute exemption.
The definition of personal information to which section 40 applies is wide
and can include references to identifiable individuals. In this case, the
Department considers that the names fall within the ambit of the first
Data Protection Principle, that the Personal data must be processed fairly
and lawfully and, in particular, must not be processed unless at least one
of the conditions in Schedule 2 to the DPA is met. Our view is that
release of the names would not be fair and that none of the conditions of
Schedule 2 are met.
The information supplied to you continues to be protected by the
Copyright, Designs and Patents Act 1988. You are free to use it for your
own purposes, including any non-commercial research you are doing and for
the purposes of news reporting. Any other re-use, for example commercial
publication, would require the permission of the copyright holder. You can
