Dear Fife Council,

I live in Stenton which has just sustained flooding to our back
gardens - due to a burst manhole and rain. Fife Council are
"passing the buck" to Scottish Water and vice versa. Who is
responsible for the maintenance of manholes (more specifically
burst manholes)?

The manhole in particular is located to the East, off Mar Drive
(327719,698979) on what I assume is Fife Council land, and is to
the rear of properties in Mey Green. The manhole can be seen
clearly on a google map and the public footpath that runs at the
back of our affected properties.

Please can you clarify who: a) owns the land where the manhole is
situated, b) who is responsible for the maintenance of said manhole
and c) if it is Fife Council's responsibility, how often are
manholes "cleaned" (ie annually inspected and recorded,
"as-in-when" etc).

Dear Fife Council,

I look forward to receiving an answer to my request.

This is my second chase up. I called Fife Council last week and
spoke with a Mike Teasdale's PA, I think called Julie who said she
would call me back with info, but to date I am still waiting.

Surely you must have a database of your assets, their owners,
responsible persons etc. I don't understand why it is taking this
long to provide this information.

ENVIRONMENTAL INFORMATION (SCOTLAND) REGULATIONS 2004 – REQUEST FOR
INFORMATION

I refer to your e-mail of 21^st July 2010 asking for information about a
manhole off Mar Drive in Stenton. We have dealt with your request in
terms of the Environmental Information (Scotland) Regulations 2004. We
apologise for the delay in responding to your request but it has been
difficult to find the information you asked for.

You asked three questions about the manhole:

1. who owns the land where the manhole is situated
2. who is responsible for the maintenance of the manhole
3. if it is the Council’s responsibility, how often is manholes
cleaned.

Using the map reference you provided (327719, 698979), we located the site
of the manhole, as indicated on the attached map. The manhole is situated
in a grassed area behind houses near 29 Mey Green. The adjacent footpath
is not adopted by Transportation Services nor is it maintained by us. It
has now been established that the grassed area in which the manhole is
situated belongs to Parks and Countryside, which is part of Fife
Council’s Housing and Communities Services. However, they have not been
able to provide any information in relation to the manhole itself.

As far as Transportation Services is concerned, manholes are inspected
every two years and pipe drains are inspected every 10 years, if resources
and budgets permit. Clearance of obstructions and siltation is undertaken
as required.

In a further request dated 27^th August you asked for a copy of a CCTV
report which was undertaken in the Mar Drive/Mey Green area of Stenton on
Friday 23^rd July 2007. We have also dealt with that request in terms of
the Environmental Information (Scotland) Regulations 2004. We have, in
our office in Strathore Road, Thornton, a record of a camera inspection of
certain pipes in Mey Green, Stenton,on 23^rd July 2010, but it is not
possible to copy that record. It can be made available for you to view at
our Thornton office and if you wish to make arrangements for that you
should contact Bill Liddle, Lead Officer, Roads and Lighting Response on
08451 555555, extension 444627.

In a further information request dated 1^st September you asked also for
any inspection reports of the surface water draining system in Mar Drive
and Mey Green for the months of July and August 2010. We have also dealt
with that request in terms of the Environmental Information (Scotland)
Regulations 2004. There were no regular inspections during that period.
However, we have an inspection report issued in connection with the camera
survey on 23^rd July 2010, referred to above, and we attach a copy of that
report to this response.

We hope you find this information useful.

If you are not satisfied with the way we have handled your request, you
have the right to request a review of the decision. Please write to:
Chief Legal Officer, Performance & Organisational Support, Fife House,
North Street, Glenrothes, KY7 5LT or e-mail to . The law provides for you
to make this request up to 40 workings days from when you receive this
correspondence. We add a further three working days to allow time for
delivery of our response giving you up to 43 working days from the date of
this correspondence to ask for a review. Where the outcome of the review
fails to resolve the matter to your complete satisfaction you have the
right to apply to the Scottish Information Commissioner for a decision.

Fife Council will consider and seek to resolve any request to the Chief
Legal Officer that falls outside this timescale.
