I am writing in respect of your recent enquiry for information held by the
council under the provisions of the Freedom of Information Act.

Under the Freedom of Information Act, the authority has the right to
refuse applicant information held if an exemption applies. The authority
believes in this case such an exemption applies and has decided to refuse
your request.

Details of Exemption applied

AE: Information accessible to the requestor by other means. This applies
where the information requested has already made available for example via
the Council's Publication Scheme or is already available by virtue of
other legislation. The information requested, must for this exemption to
apply, be reasonably accessible to the requestor.

All planning files that have been decided have been archived. These files
are available to the public at a fee of **5.50 per file for residents &
**11.00 for commercial use.

To request an archived file call the planning reception on 020 8359
4561. Payment will need to be made before the file is retrieved,
unfortunately it can take up to ten working days for the file to be
retrieved from the archives.

We will contact you once the file has been retrieved from the archive to
arrange viewing. The file will be held in the planning reception for a
maximum of 5 working days.

Copies of documentation within the files can be made at reception for the
appropriate fee.

If you need to view objection letters you will have to notify the planning
reception, when making your request as this process will take up to 10
working days.

However some of the documents are so old, it is not always possible to
retrieve them. It is always necessary to call and make the file request
before you visit our office as the files are not kept in the same location
at planning reception.

If you wish to object to our decision in the first instance, you may
approach the council's Complaints Officer in writing to: Complaints
Officer, London Borough of Barnet, North London Business Park, Oakleigh Rd
South, London N11 1NP. Should you remain dissatisfied, you can appeal
against the decision by contacting the Information Commissioner, Wycliffe
House, Water Lane, Wilmslow SK9 5AF.

Any future correspondence you may have with the authority in relation to
this matter should be marked private and confidential and sent to the
Freedom of Information Officer, North London Business Park, Oakleigh Rd
South, London N11 1NP.
