Dear Sir or Madam,

Please could you tell me what is the time scale for a DLA Appeal. I
would particularly like to know how long the DLA have to arrange an
appeal date. What is the law on the DLA running out of time and the
appeal being upheld? As the public only get 28days to make the
appeal, surely they have a time limit to prove their case?

Thank you for your request for information as below.

What is the time scale for a DLA Appeal. I would particularly like to
know how long the DLA have to arrange an appeal date. What is the law on
the DLA running out of time and the appeal being upheld? As the public
only get 28days to make the appeal, surely they have a time limit to
prove their case?

Your request was received on 30/12/08 and I am dealing with it under the
terms of the Freedom of Information Act 2000. Therefore you can expect a
reply by 28/1/09 unless I need to come back to you to clarify your
request or the balance of the public interest test needs to be
considered.

Would it be possible to extend this request to details of the time limits for responding to appeals against decisions made regarding any form of benefit (as I and I'm sure many others have failed to receive an adequate answer to that question verbally)?

I have a particular interest in the DWP's response to this request as they have failed to give any response within 20 working days (currently 30 working days and counting) to a request I made (not through this site but in writing with documentary proof of their receipt) under the FoIA and DPA regarding the status of a couple of benefit appeals, as well as to those appeals.
