Dear Sir or Madam,
Please advise the following information in respect of your
'Diversity Unit' (or similar) as at the date of this request:
1. Total staff employed within the unit;
2. How many of these are male;
3. How many are recorded as being disabled;
4. How many are recorded as being other than 'White-British'
5. How many are recorded as being other than 'heterosexual'.
And in regard to your 'Human Resources' department; what is the
total number staff employed solely within HR and how many of these
are male.

FREEDOM OF INFORMATION REQUEST REFERENCE NO: 0449/09
In reply to your request for information under the Freedom of Information
Act 2000, received 25/08/09.
The Freedom of Information Act 2000 (The Act) requires us to handle all
requests in a manner that is blind to the identity of the requestor. Any
information released in response to a request is regarded as being
published, and therefore in the public domain without caveat.
Request
Please advise the following information in respect of your 'Diversity
Unit' (or similar) as at the date of this request:
1. Total staff employed within the unit;
2. How many of these are male;
3. How many are recorded as being disabled;
4. How many are recorded as being other than 'White-British'
5. How many are recorded as being other than 'heterosexual'.
6. And in regard to your 'Human Resources' department; what is the total
number staff employed solely within HR and how many of these are male.
We have completed all searches within Cambridgeshire Constabulary and
hereby enclose your response.
Response

3. In respect of Section 1(1)(a) of the FOI Act I can confirm that
Cambridgeshire Constabulary do hold information about.....
Section 17 of the Freedom of Information Act 2000 requires Cambridgeshire
Constabulary, when refusing to provide such information (because the
information is exempt) to provide you the applicant with a notice which:
(a) states that fact, (b) specifies the exemption in question and (c)
states (if that would not otherwise be apparent) why the exemption applies.
The exemptions applicable to the information are:
Section 40(2) applies to third party personal data. This would not be
released under the Freedom of Information Act unless there is a strong
public interest. This is because any release would breach the Data
Protection Principles contained within the Data Protection Act (1998).
Section 40 is an absolute, class-based exemption and as such does not
require a statement of potential harm nor require a public interest test to
be performed.

In accordance with the Act, this letter represents a Refusal Notice for
this particular part of your request.

5. All hetrosexual or prefer not to say
This information does not have to be declared by the staff as it is
considered to be sensitive personal information, as such it may not be an
entirely accurate.

Thank you for your response, however I am not entirely content with
the responses to questions 3 or 5 since the response to q3 does not
seem logical when set against the answers to the other questions.
Why is disability more personal than ethnic origin for example (to
which S40 has not been applied)? (This is not a new request for
information!)
In respect of Q5 this does not answer the question since it needs
to be a number rather than a statement.
Please note, I am not seeking a formal review of your response, I
merely ask that you consider what you have written and decide
whether Q5 should have been answered differently. If so, then
please provide the number who have not declared themselves as not
being heterosexual even if they have classed themselves as "prefer
not to say"!

Further to your email below I can advise the following :-
Firstly with regard to Question 5 -
Our records show
3 Heterosexual, 1 prefer not to say
This particular information does not have to be declared by all staff as it
is considered to be sensitive personal information, therefore as such it
may not be entirely accurate.
Question 3 - Your comments are noted around the response to question 3.
I can only advise you that should you feel an exemption has been
incorrectly applied the option available to you is to request an internal
review by our Appeals Panel.
