department and the tube unions (RMT, ASLEF, TSSA, and Unite) in
relation to any discussions towards reaching a 'no strike deal'.

- Minutes of any meetings between the Employee Relations and the
tube unions on the same subject.

Dear M Deutsch

Subject: Outcome of internal review

The internal review of Transport for London's (TfL) handling of your
request for correspondence between TfL and the Tube Unions in relation to
the `no strike deal' has been completed. The review was carried out by a
Review Panel (`the Panel') consisting of individuals who were not involved
in the handling of your request.

Having reviewed all of the correspondence held in relation to your
request, the panel agree that miscommunication between business areas and
unsatisfactory lengthy response times from individuals who have been
approached for a contribution has led to your request not being expedited
as per TfL's FOI process.

Due to this your request is severely over the 20 working day deadline and
in breach of the Freedom of Information Act 2000. Please accept our
apologies for all the errors which have occurred whilst dealing with your
request.

The Panel will discuss all of the concerns outlined above with the
Information Access and Compliance Team who in turn will address them with
the individuals concerned.

In line with TFL's procedure, any response to an FOI request which is
deemed to be of a complex nature requires approval of the appropriate
senior manager from the relevant business area. At this time TfL's
response to your request is being approved and will be sent to you
shortly.

I hope this information is of assistance. If you are dissatisfied with the
outcome of this internal review, you can refer the matter to the
independent authority responsible for enforcing the Freedom of Information
Act at the following address.

It has now been three weeks since I was promised I would receive
the requested information "shortly".

I feel this is unacceptable, particularly given that the initial
request was made in January.

I have reported this clear breach of the Freedom of Information Act
to the Information Commissioner's Office.

I would appreciate it if you could give some kind of indication of
when, if ever, you will release the information that I requested.

Further to my email below I have now received an update from the London
Underground Customer Service Team.

As advised in my email of the 6^th April, in line with TfL’s procedure,
any response to an FOI which is deemed to be of a complex nature requires
approval of the appropriate senior management from the relevant business
area.

In this instance your request was deemed to be ‘complex’ and TfL’s
response required the appropriate management approval.  Unfortunately a
delay has occurred within this process, which understandably has caused
you frustration and inconvenience.

I have escalated your complaint to the Head of Information Access and
Compliance, who will assist in expediting a response to your request.

Again, please accept my apologies for the further delays caused.

transport trade unions, and they have clarified their position on
such a proposal."

the Information Commissioner's Office has replied to my complaint, and has decided that "although a clear breach of the Act did occur, I am satisfied that the authority has recognised this and, therefore, the Commissioner does not consider that serving a formal decision notice would serve any strong public interest. I have, however, written to the public authority reminding it of its responsibilities."
