Dear Sir or Madam,
As you are aware, a senior investigator with the IPCC--Mr Kevin
Hamilton--was suspended following his arrest for harassing a
neighbour pending an investigation in 2006.
I am very interested in the investigation and any reports that were
compiled. I am not familiar with the police procedure for
disciplinary matters and therefore am unable to request specific
documents.
Pursuant to Section 10 of FOI Code of Practice:
"providing an outline of the different kinds of information which
might meet the terms of the request;
providing access to detailed catalogues and indexes, where these
are available, to help the applicant ascertain the nature and
extent of the information held by the authority"
Would you please be kind enough to provide me a 'detailed
catalogue' of materials held that you feel is relevant to my
request.

Re: Your Request under the Freedom of Information Act 2000
Thank you for your e-mail dated 31 August 2009, in which you ask for
information about Kevin Hamilton following his arrest for harassment. In
your e-mail you ask for details about the investigation, and for any
reports that were compiled by the IPCC.
I am writing to advise you that, in accordance with section 1(1)(a) and
1(1)(b) of the Freedom of Information Act:
1.-(1) Any person making a request for information to a public authority
is entitled-
(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request, and
(b) if that is the case, to have that information communicated to him
Kindly note that the investigation was conducted by the police, the IPCC
did not conduct an investigation into the offence. Kevin Hamilton has
resigned from the IPCC. We do not hold any information about the
investigation or any reports about the offence of harassment. Therefore,
this information is not held by the IPCC.
You may wish to ask Cheshire Constabulary to find out if they hold this
information, their contact details are as follows:

Many thanks for email today. You stated that you hold no
information related to my request.
Perhaps I did not make this clear in my request but I was
interested in an index of documents surrounding the the offence and
IPCC response.
As I stated in my original request to yourself, I am unfamiliar
with the police procedure concerning disciplinary matters, however
I would imagine an index of documents to include but not be limited
to:
* Minutes of meetings concerning Mr Hamilton's employment status.
* Communication between yourselves and Cheshire Police.
* Communication between yourselves and Mr Hamilton concerning his
suspension.
* Mr Hamilton's resignation letter.
I am aware much of this information may be exempt from FOIA release
however, I only requested an index or catalogue of held
information.
