SUBJECT: Freedom of Information Request

Thank you for your correspondence of December 23, 2009, in which you
asked for information about children removed from parents by order of
court under the Freedom of Information Act 2000 (FOIA) from the Ministry
of Justice (MoJ).

You will receive a response from us by January 25, 2010. Your request
has been passed to the appropriate business unit within the MoJ, and
they will write to you with their decision by this date.

The FOIA does provide a number of exemptions. A qualified exemption
requires that before relying on it we must consider the public interest
test. If the information you have requested is covered by a qualified
exemption(s) under FOIA, the Department is allowed to take longer than
20 working days to respond. This is because in such circumstances we are
required to consider the public interest issues when deciding whether or
not to disclose the information requested.

If more time is needed to consider the public interest issues under a
qualified exemption(s), we will write to you and inform you of the
revised date you can expect to receive a response to your request.

Dear Holden, Lance,

Thank you. As explained, the Dept needs to understand the primacy
law, the Childrens' Act comes first -above any other law, this
information is of public interest, to protect children mainly, the
Dept ought to have this information and is no reflection on the
handling of the request by your good staff, but of the direction by
management that this information is not held, when it is the view
of the Childrens' Act and the public (to my knowledge) that this
information must be held by this and other public offices that
directly influence the lives of families in the UK and especially
the children, I request and independent internal review of this
lack of adherement to the Childrens' Act' Act by this government
and suggest it is endangering thousands of children to not hold or
to not provide such information
