Disability

Paul Gaffney made this Freedom of Information request to House of Commons

The request was partially successful.

From: Paul Gaffney

26 November 2009

Dear Sir or Madam,

A few questions
1)Does a member have to disclose disability at any point?
2)If so would such disability be public knowledge?
3)If such figures public ...could I have a breakdown of them?
4)i believe there is a section 141 of a certain piece of
legislation that would mean a member would lose their seat if they
were thought 'mentally ill' for a length of time.Is this
legislation still in force? If it is would it not be contrary to
article 14 of the ECHR?

Yours faithfully,

Paul GaffneyLLB BA

Dear Mr Gaffney

Thank you for your request for information which is copied below. In response to your questions:

Q1-3

A member is not required to disclose any disability

Q4

It is not clear what information is sought from the House of Commons. Please refer to information on the Parliamentary website www.parliament.uk and use the search engine of the website to look for information you require. A good place to start would be the Acts of Parliament Web database, for example, the 1983 Mental Health Act. This legislation is still in force. http://www.statutelaw.gov.uk/legResults....

Should you wish to make a request for specific information, please let us know.

You may, if dissatisfied with the treatment of your request, ask the House of Commons to conduct an internal review of this decision. Requests for internal review should be addressed to: Freedom of Information Officer, Department of Resources, House of Commons London SW1 OAA or [House of Commons request email]. Please ensure that you specify the nature of your complaint and any arguments or points that you wish to make.

If you remain dissatisfied, you may appeal to the Information Commissioner at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.

Yours sincerely

Bob Castle

Head of Information Rights and Information Security
