provision of digital TV in preparation for analogue switch-off for

Dear Mr Grade,
The London Borough of Barking & Dagenham has approximately 12,500 properties that have a communal TV system. The Council does not own the systems but leases them with a repair and maintenance clause in the contract.
The upgrade to digital TV receiving capability ('Freeview') was completed in December 2004. It was carried out in response to the Government's requirement that every resident should have access to digital information and the fact that the analogue service is being withdrawn between 2008 and 2012 - meaning that the residents will need an aerial capable of receiving digital signals.
The Council took legal advice regarding the 35p per week service charge which were imposed under Conditions 1(4) and 2(2) of the Conditions of Tenancy in force in 2004. The Council did not have a duty to consult with Leaseholders as their individual contribution did not exceed £100 per year and with tenants as their contribution would not exceed £50 per year.
The Council has worked hard to keep the service charge to a minimum for all residents. Those tenants in receipt of a Housing Benefit claim would have been automatically adjusted from 2 August 2004 and will not have to pay any more than they currently do.
