Dear Sir or Madam,

Could you please provide me with

[1] all documents relating to any complaint made against DC Anning
(Cornwall police) regarding homophobia
[2] all documents relating to any internal investigation of DC
Anning by Devon and Cornwall Constabulary

I ask this as I sincerely believe a formal complaint I have
previously made & the interconnected nature of several other
Cornwall police homophobic incidents, attitudes & practises have
been covered up by the Devon & Cornwall Constabulary

Dear Mr Lidbury

I write in connection with your request for information which was received
by this office on May 11, 2009. I understand you are requesting the
following information:

[1] all documents relating to any complaint made against DC Anning
(Cornwall police) regarding homophobia [2] all documents relating
to any internal investigation of DC Anning by Devon and Cornwall
Constabulary

I note that this request is identical to request number 366/2009-01331,
which was acknowledged at 09:58 this morning and to request number
371/2009-01336, which was responded to at 11:06 this morning advising that
the request was repeated. Therefore, this request will also be closed and
dealt with under the first reference number of 366/2009-01331.

Should you have any further inquiries concerning this matter, please
contact me quoting my reference number as above.

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews. My understanding is that by LAW a response was
due by no later than the 9th of June 2009.

Due to my personal experience of multiple Cornwall police
homophobic attitudes & practises I have no reason to doubt that
this contempt & prejudice is in fact widespread throughout the
Devon & Cornwall Constabulary, reflective in contempt shown in not
completing this FOI request within the law.

I am writing to request an internal review of Devon and Cornwall
Constabulary's handling of my FOI request 'Devon & Cornwall
Constabulary Homophobia'.

FREEDOM OF INFORMATION REQUEST NO 373/2009-01338

Thank you for your below email. I'm writing to inform you that this request was closed on May 12, 2009. Please see the attached response email sent on the same day. Pursuant to the provisions of Section 14 of the Freedom of Information Act 2000 (the Act) your request was refused as it was deemed a ‘Repeated Request’.

Reason for Decision
Section 14(2) of the Act provides:

Where a public authority has previously complied with/or is currently dealing with a request for information which was made by any person, it is not obliged to comply with a subsequent identical or substantially similar request from that person unless a reasonable interval has elapsed between compliance with the previous request and the making of the current request.

It was clear that a ‘reasonable interval’ had not elapsed between your requests.

Complaint Rights
You have the right to ask us to review this decision. If you wish us to review this decision please set out your grounds for review in writing and send them to the Head of Information Management, Information Management Department, Devon & Cornwall Constabulary, Middlemoor, Exeter, EX2 7HQ, Devon.

I am satisfied that this has been rejected as it was a repeat application due to a glichy computer where I was unsure whether the original request was sent.

I look forward to the original FOI request regarding DC Anning & those of the numerous other FOI requests concerning the conduct & attitudes of numerous other Devon & Cornwall police officers against gay persons.
