Dear Mr Clarke,
Thank you for your request for information received on the 9 February
2010. The information you require is in the public domain and does not
need to be dealt with as a freedom of information request.
I will respond to the points you have made as follows
The advertisement located above the `Cheque Centre' does not benefit from
advertisement consent nor does the sign come within the provisions of any
of the 14 classes of deemed consent for which advertisement consent is not
required. As such the advert is illegal.
The maximum dimensions for a sign which does not require advertisement
consent falls within Class 5 of the 14 Classes of deemed consent. Class 5
deals with advertisements on business premises. To view the exact
specification of Class 5 including size requirements please visit the
Communities and Local Government website on [1]www.communities.gov.uk.
I can confirm that the Cheque Centre shop unit does lie within the
Ormskirk Town Centre conservation area.
As the sign is illegal no planning officers were involved in granting
permission for it, however, the Councils enforcement team has been taking
the appropriate action to secure its removal. I am the officer dealing
with the case and you can contact me on 01695 585 345. The owners of the
Cheque Centre have agreed to remove it and replace it with a sign that
falls within Class 5. It is hoped that work to replace the sign will
start on site shortly.
I trust that the above is of assistance to you.
Yours sincerely,
Dominic Carr
