Dear Ms. Davis

FREEDOM OF INFORMATION REQUEST REF: 2010-470

I am responding to your request under the Freedom of Information Act 2000,
which we received on 9 July 2010 for information held by the Council. You
requested:

(a) addresses and rateable values of all properties that have any historic
credit on their account

(b) the names and addresses of the owners of those properties referred to
in (a)

I can confirm that the Council holds the requested information. However,
under section 41 of the FOI Act, we are permitted to withhold from
disclosure information which has been provided to the Council in
confidence. The information you have requested is obtained from ratepayers
under a statutory power. For example, ratepayers are compelled to provide
the information for a specific purpose and they have a legitimate
expectation that the information they provide will only be used for that
purpose and will not be made available to the general public on an
indiscriminate basis.

Although section 41 is an absolute exemption in terms of the FOI Act, the
duty of confidence is still subject to the common law public interest test
and therefore we have given consideration as whether there is an
overriding public interest in disclosing the information. Although we
acknowledge that your company has a private interest in the information
and so do potentially companies or persons who would benefit from knowing
that they have overpaid business rates. It is our belief that the there is
no overriding public interest in disclosing the information as ratepayers
provide the information under a statutory obligation in the knowledge that
it will be treated confidentially by local authorities and will not be
used for further purposes or released into the public domain.
