Please could you supply me with a list of Byways Open to All
Traffic in Oxfordshire, with a description of each byway,
sufficient to locate it's route.
If possible could this information be in a documented, open,
computer readable format, such as a series of Geography Markup
Language geometries.

Please could you supply me with a list of Byways Open to All
Traffic in Oxfordshire, with a description of each byway,
sufficient to locate it's route.
If possible could this information be in a documented, open,
computer readable format, such as a series of Geography Markup
Language geometries.
Your request is being considered and you will receive the information
requested as soon as possible and in any event within the next 20 working
days in compliance with the Freedom of Information Act 2000, unless an
exemption applies. This means that the council will respond to you by 3
March 2009.
There may be a fee payable for this information. You will be informed if
this is the case and you can decide if you wish to proceed with your
request.
If appropriate, the information requested can be made available in
alternative formats, including other languages, Braille, large print, and
audiocassette. If you require any of these formats then please let me
know.

Dear Mr Davis,
Thank you for your request of 3 February in which you asked for the
following information:
Please could you supply me with a list of Byways Open to All
Traffic in Oxfordshire, with a description of each byway,
sufficient to locate it's route.
If possible could this information be in a documented, open,
computer readable format, such as a series of Geography Markup
Language geometries.
This information is not available to you under the Freedom of Information
Act (FOIA) because an exemption applies. In this case the exemption is
Section 21 of the FOIA, namely that the information is reasonably
accessible to the applicant by other means.
Byways Open to All Traffic in Oxfordshire are included on the Definitive
Map and Statement (DM&S) of Public Rights of Way for Oxfordshire, (i.e.
the legal record of public footpaths, bridleways, byways and restricted
byways) which has a relevant date of 1 February 2006. This is available
for public inspection at locations throughout Oxfordshire. Information
about the DM&S and where you can go to see it is available on Oxfordshire
County Council's public website [1]www.oxfordshire.gov.uk/definitivemap.
In addition, this information is passed to Ordnance Survey which shows
Byways Open to All Traffic and other public rights of way on its
`Landranger' and `Explorer' series of maps.

Dear Rachel Skeet,
I would like to able to access the information requested in a way
that would allow me to transcribe the information without loss of
accuracy.
I understand that I am able to view the definitive map, but viewing
the map would not allow accurate, or complete transcription of the
data to the same level of accuracy as information stored in your
systems.
It may not have been implicit in my initial e-mail but the
completeness of the data is an important part of my request.
I do not feel that the information requested is reasonably
accessible to me by these means (although I'm happy to be
corrected). Please can I request an internal review of this
decision.

I refer to your email of 09 February, which was sent to Rachel Skeet,
requesting a further review of your FOI request. To ensure we give proper
consideration to your concerns we will deal with this at stage 1 of the
Council's complaints procedure, a copy of the procedure is attached for
your information.
Your complaint will be investigated at Stage 1 of the procedure by Glenn
Watson, Democratic Support Manager he will let you have a response within
10 days of date of this acknowledgment i.e. by 24 February. If your are
unhappy with the response you receive at stage 1 the next step will be to
contact the Information commissioner and you will be given details of how
to do this within the response.

Dear Mr Davis
I am writing in response to your request for a further review of the
Freedom of Information request which you made, requesting details of
Byways Open to All Traffic in Oxfordshire (ideally in a Geographic Markup
Language).
I have reviewed this matter and, unfortunately, we are not able to supply
this information to you in the manner in which you wish to receive it.
This is because, unlike some local authorities, the County Council does
not have either the Definitive Map or the Statement available in
electronic form. A project is in the early stages of development with a
view to producing the information in such a format, but the timescales for
this are not imminent and the information is certainly not available now
and is unlikely to be so for the forseeable future.
It would have been helpful if the previous response to you had been more
explicit about the reasons why we could not supply the requested
information to you. However, I am sorry that the Council cannot comply
with your request: if we were able to do so, we would be happy to oblige
you but unfortunately we cannot.
This is why the previous reply directed you to the locations of the hard
copies of our Definitive Map and Statement. I again attach a link (at the
foot of this email) to our website, which specifies the locations.
You are at liberty to take your concerns further with the Information
Commissioner's office (details below) if you are not satisfied with my
response. I am sorry not to be able to assist you further directly.
