Dear Sir or Madam,

I read with interest that The Treasury Operational Efficiency
Programme Review will consider the scope for improved asset
management across Government,including a review of the British
Waterways non-operational property portfolio, and business model,
to consider how its assets might best deliver public value.

In the terms of reference of this review, what defines a site owned
by British Waterways as non-operational?

Dear Sir or Madam,

On the 12th December I made a request under the Freedom of
Information Act regarding The Treasury Operational Efficiency
Programme Review of the British
Waterways non-operational property portfolio, and business model,to
consider how its assets might best deliver public value.

My request was: in the terms of reference of this review, what
defines a site owned
by British Waterways as non-operational?

You should have responded to me by February 23rd 2009, according to
the timeframe set out in the Act, and I would now like a prompt
reply.

Dear Lisa,

I am writing further to my e-mail of 30 March and your request to know:

"In the terms of reference to the OEP review what defines a site owned by
BW as `Non Operational'?"

We have considered your request for information and I am now able to
answer as follows.

British Waterways' operational property is that property required for
operational purposes. Non operational property is property owed for the
purposes of generating a financial return to contribute to the running
costs of the waterways.

Should you feel that I have not properly considered your request for
information, or you remain dissatisfied with British Waterways in this
regard, you are entitled to have your complaint considered by our
complaints process. If this is the case, please write to me at 64
