Thank you for your e-mail of 30 September 2009 11:18 and the accompanying
FoI request

An initial search for documents that could be considered within the scope
of the request has revealed a large number of documents that could be
considered within the scope of your eighth point as it stands in your
original request.

8) Dates/agendas/minutes/briefing notes of meetings between David
Hendon, and the executive/non-executive management of British
Telecom

This is a very wide ranging request as David Hendon frequently meets with
senior staff of BT to discuss matters of mutual interest. In order to
keep your request with the cost limit of £600 that each FoI request
attracts. I would be grateful if you would let me know of the particular
subject or subjects that you feel the search should encompass.

Hendon discussed matters related to 121Media/Phorm advertising
systems, or the Government's response to the European Commission's
recent infringement proceedings.

Many thanks for your reply, but I am confused.

David Hendon is Director, Business Relations; responsible for
BERR's business-facing activities and policy in communications &
broadcasting networks, Internet, software and computer services,
information security, electronics, digital content, media,
publishing, postal, chemicals, construction and retail sectors.

If the content of your response to my FOI request is correct,
despite a covert surveillance scandal which has involved the
European Commission in Infraction Proceedings against the UK
Government... and a complaint to the Crown Prosecution Service
alleging fraud, computer misuse, illegal interception of
telecommunications, data protection offences, and intellectual
property crimes... David Hendon has had no written communication
with his Permanent Secretary, the Secretary of State, British
Telecom, or Phorm since October/November last year concerning the
matter. Nor has he met with BT or Phorm to discuss the matter.

Please would you review your response? I think there might be some
mistake.

Otherwise, please could you advise me which Director/Permanent
Secretary has responsibility for matters concerning the BT/Phorm
scandal, if not David Hendon?

Dear Mr Balchin,

concerning this FoI request;

In separate FoI disclosures, it seems Jane Chelliah Manning wrote
to various members of BR2 on 19 September 2009 11:08 discussing a
letter received from BT.

She says in her email "Please find attached the letter received
from BT on Phorm and the draft reply back. to [obfuscated]. The
reply to that letter will be signed by David Hendon".

She even went on to say in an email later the same day "I assumed
David would add his finishing touches, much like Ministers do some
times".

I asked you to disclose to me "2) Correspondence (letter, fax,
email etc) between David Hendon and
BT, concerning Phorm and/or trials of 121Media products"

Please disclose that letter from BT to David Hendon, and the
corresponding reply from David Hendon to BT without delay. (I don't
recall seeing that letter in earlier disclosures, and it was not
included in the response to this request either).

Please confirm that the letter from BT was sent by Ian Livingston,
and the reply from David Hendon was sent to Ian Livingston.

Please all disclose any other items of written correspondence
between David Hendon and BT (or Phorm) that you have overlooked.
