Dear Sir or Madam,
I am contacting you concerning the Dangerous Dogs Act 1991, as
amended, legislation.
1) How many dogs have been seized by Avon and Somerset police force
under Section One of the Dangerous Dogs Act in each year from 2000
to 2008?
2) How many prosecutions under Section One and Section Three of the
Dangerous Dogs Act did your police force proceed with in 2007 and
2008?
3)How many dogs have been seized under Section One of the Dangerous
Dogs Act so far this year (2009)? Of those seized, how many have
been signed over for destruction by their owners?
4) How many applications have been made to the magistrates court
under section 4b of the Dangerous Dogs Act in the last three years?
Of those 4b applications, how many resulted in destruction orders
and how many resulted in registration onto the Index of Exempted
Dogs?
5) How many dogs are currently held by your police force under
Section One and Section Three of the Dangerous Dogs Act?
6) What number of dogs seized under Section One of the Dangerous
Dogs Act over the last three years, have been destroyed or have
died whilst in police custody, due to illness, injury or disease?

to dangerous dogs. This request will be dealt with under the terms of the
Freedom of Information Act 2000.

to the information not being exempt or containing a reference to a third
party. In some circumstances Avon and Somerset Constabulary may be unable
to achieve this deadline. If this is likely you will be informed and given
a revised time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will

I write in connection with your request for information dated 30^th March
concerning the dangerous dogs act 1991. I would firstly like to apologise
for the delay in responding to your request.
Your request for information has now been considered and I am unable to
supply the information you have requested:
1. How many dogs have been seized by Avon and Somerset police force
under Section one of the Dangerous Dogs Act in each year from 2000
to 2008?
Where exemptions are relied upon, Section 17 of the Freedom of Information
Act 2000 requires Avon and Somerset Constabulary, when refusing to provide
such information (because the information is exempt) to provide you the
applicant with a notice which: (a) states that fact, (b) specifies the
exemption in question and (c) states (if that would not otherwise be
apparent) why the exemption applies.
No central record is held in relation to the number of dogs seized under
section one of the Dangerous Dogs Act. Therefore in order to provide you
with a response in relation to this part of your request, consultation
between many separate departments, districts and officers would need to be
undertaken in order to collate the required information. The cost of
providing you with the information is above the amount to which we are
legally required to respond i.e. the cost of locating and retrieving the
information exceeds the "appropriate level" as stated in the Freedom of
Information (Fees and Appropriate Limit) Regulations 2004. It is estimated
that it would cost at least £450 to comply with your request.
In accordance with the Act, this letter represents a Refusal Notice for
this part of your request.

Prosecutions under section one of the Dangerous Dogs Act:
No central record is held in relation to the number of prosecutions under
section one of the Dangerous Dogs Act. Therefore in order to provide you
with a response in relation to this part of your request, consultation
between many separate departments and officers would need to be undertaken
in order to collate the required information. The cost of providing you
with the information is above the amount to which we are legally required
to respond i.e. the cost of locating and retrieving the information
exceeds the "appropriate level" as stated in the Freedom of Information
(Fees and Appropriate Limit) Regulations 2004. It is estimated that it

have been signed over for destruction by their owners?
This information is not recorded by Avon and Somerset Constabulary,
therefore no information is held.
4) How many applications have been made to the magistrates court
under section 4b of the Dangerous Dogs Act in the last three years?
