Dear Sir or Madam,
What number of application to the magistrates court under section
4b of the Dangerous Dogs Act 1991, as amended, have been made in
each year from 2000 to 2008?
Of these 4b applications to the court, in each case, how many
resulted in court destructions orders for the dog and how many
resulted in the dog being added to the Index of Exempted Dogs via
court order?
How many dogs have been seized under Section One and Section Three
of the Dangerous Dogs Act in 2008?
How many dogs have been seized under Section One of the Dangerous
Dogs Act so far this year (2009)? Of those seized, what number were
signed over for destruction by their owners? What number of seized
dogs have died due to illness, injury or disease?
How many dogs are currently held by the police as prohiited types?

Dear Ms Dunckley
I refer to your recent request for information under the Freedom of
Information Act 2000 as set out below:
What number of application to the magistrates court under section
4b of the Dangerous Dogs Act 1991, as amended, have been made in
each year from 2000 to 2008?
Of these 4b applications to the court, in each case, how many
resulted in court destructions orders for the dog and how many
resulted in the dog being added to the Index of Exempted Dogs via
court order?
How many dogs have been seized under Section One and Section Three
of the Dangerous Dogs Act in 2008?
How many dogs have been seized under Section One of the Dangerous
Dogs Act so far this year (2009)? Of those seized, what number were
signed over for destruction by their owners? What number of seized
dogs have died due to illness, injury or disease?
How many dogs are currently held by the police as prohiited types?
In accordance with section 1(1) (a) of the Act our response is provided
below;
In respect of your questions relating to section 4b of the Dangerous Dogs
Act 1991. There is no information held.
It has been suggested that this information is only held by the Magistrates
Courts as it relates to orders made by the Magistrates.
In respect of the remaining parts of your questions. Cheshire Police no
longer seize or take possession of dogs. This function is carried out by
the local authorities who have responsibility for the seizure and
kennelling of dogs. Again therefore there is no information held.
It may be of assistance for you to note that during 2006 and 2007 Fifteen
summonses were issued for offences against section 1 of the Dangerous Dogs
Act 1991.
If I can be of any further assistance in this matter, please do not
hesitate to contact me.
