Dear Sir or Madam,
I would like to know why the grass on the highway verge, play area
and open space between Firtree Close and Linwood (Both off Rookery
Rise, Winsford) was recently cut but all other verges and open
space along the full length of Rookery Rise was not cut.
In addition I would like to know who carried out the work and why.

Further to my email of 12 September, I have attached a Google aerial
photograph and I have outlined what I believe are the open spaces and play
area you have referred to (adjacent to Linwood and Firtree Close). If I
have correctly identified these areas, the Land Registry has now responded
and has confirmed that these are currently owned by BDW Trading Limited
(previously Barratt Homes).
With regard to why these areas have remained with the developer, our Head
of Streetscene needs to do some further investigation as any officers
dealing with that site have since left the Authority. I have asked the
Head of Service to let me have his reply as soon as possible and I will in
turn ensure that you are informed without delay.
In the meantime, you have also asked who cut the grass on the highway
verge, play area and open space between Firtree Close and Linwood and
why. I have spoken to our Streetcare Manager and he has confirmed that
his officers have not carried out this work. He does not know who did,
but his operatives have reported seeing what they assumed was a contractor
maintaining the grass in that area.
I hope the above information is helpful. I will write again as soon as I
have further information for you.

Dear Clarke, Sue,
The key issue here is why has Vale Royal Borough Council failed to
enforce the planning permission granted to Barratt (in particularly
the section 106 agreement) restricting the occupation of a number
of dwellings on the site until the play area and open space were
transferred to the council.
This issue has been brought to your attention before. On that
occasion I received a ridiculous response from Vale Royal Borough
Council stating that they would have no way of knowing if the said
dwellings were occupied. Even though the people occupying the
dwellings have been paying council tax to Vale Royal Borough
Council since 2001 when Barratt left the site.

Vale Royal Borough Council are playing silly games.
Firstly they reply to only one of my on-line FOI requests but include information about the other two.
Then they delay matters.
Then they reply to another of my FOI requests but include information about the other two.
Then they delay matters again.
The tricks councils play to delay giving out information never ceases to amaze me. Anyone would have thought I was asking for state secrets.

Complaint sent to the Information Commissioner.
I submitted three Freedom of Information request on the 13th August to Vale Royal Borough Council using the new What Do They Know website. I have failed to get a response within the statutory 20 working days. In addition they are unnecessary delaying matters even further by wrongly suggesting that they need information from other parties to answer my query.
During 2005 I received the information requested without any of this nonsense. Therefore, I would like to submit a complaint about the way in which Vale Royal Borough Council have been delaying giving me the information requested.
