Under the Freedom of Information Act, please may I have the
following figures for your council for the years 1998 to the
present day

1) The number of people with criminal convictions employed by
Rother District Council

2) The top ten job areas where people with criminal convictions are
employed.

3) The top ten types of conviction employees have.

4) The number of disclosures requested from the CRB.

5) The number of enhanced disclosures requested from the CRB.

6) A list of positions / job titles (or summary of areas of
work)where a CRB check was requested.

Dear Ms Macpherson

FREEDOM OF INFORMATION ACT 2000

With reference to your request received on 13 October 2009 about
employment of people with criminal convictions, the Human Resources
Division have provided the following response:

!) The number of people with criminal convictions employed by RDC

We are unable to answer this question as we are not aware of any
employees with unspent convictions. Employees with spent convictions
are not required to offer information unless they work in a regulated
service. With regard to unspent convictions the following has appeared
on our Job Application forms since 2007.

REHABILITATION OF OFFENDERS ACT 1974 Please note: If the post you have
applied for meets the exemption requirements under this Act, all
applicants who are offered employment will be subject to a criminal
record check before the appointment is confirmed. This will include all
spent convictions, cautions, reprimands or final warnings. (See
information sheet for further guidance). Please declare any unspent
convictions (or all convictions if the post is exempt) on a separate
sheet and tick this box if doing so

There is no formal procedure for monitoring convictions after
appointment for non-regulated employees.

2) The top ten job areas where people with criminal
convictions are employed.

Regulated activities are few at Rother, mainly Beach Patrol/Lifeguards.
Of these only 1 had a record which dated back to early years and bore no
relation to the employability of the individual.

3) The top ten types of conviction employees have.

As there is only one instance to draw on, and taking account
of 1) above, there is no information available.

4) The number of disclosures requested from the CRB.

72 dating back to 2005 (some being repeated).

5) The number of enhanced disclosures requested from the CRB.

Generally all requests are for enhanced disclosures.

6) A list of positions/job titles (or summary of areas of work)
where a CRB check was requested.

See 2) above

You may use our internal complaints procedure if you are dissatisfied.
If you are still dissatisfied you may appeal to the Information
Commissioner. Please contact Anne Bruin, Team Leader - Customer Services,
if you wish to complain.
