Dear Sir or Madam,
Regarding Conwy & Colwyn County Court case number 8CC00525:

Please supply the following information:
A copy of the Council's policy which states it should:

b) attempt to defend a case in Court that the Council had no
reasonable chance of defending successfully, and hence wasting
taxpayers money thereon.

NOTE: to pre-empt your most likely response, I am NOT asking for
ANY legal comment OR ANY legal opinion on the above matter. I am
merely requesting a copy of Council Policy documents [material
removed]
If the actions were not in line with any Council Policy, but were
the result of a meeting, then a copy of the minutes of those
meeting(s) will suffice to answer this FOI request.

CCBC - if you do not acknowledge my request by close of business on
1st September 2009, I shall lodge a further formal complaint with
the Information Commissioner.

breaking the law (as you have done many times already)

It is a very sad state of affairs indeed that this website has been censored by the Council... But what it does is show to everyone just how low these people will stoop... What have they got to hide?... WHY ARE THEY SO DESPERATE TO STOP THE TRUTH COMING OUT?... Copies of the Councils own documents which prove what they did in Court will now be published on the Pier website - something the Council cannot censor.

THE COUNCIL LOST TODAY IN COURT.
Since I cannot upload documents to this website like the Council can, a copy of the Court Order (Judgment) will be available on the pier website as soon as it arrives in the post from the court: www.victoriapier.com So that's another £55 of taxpayers money wasted + all the Councils internal & legal costs in trying to defend this case, on top of the original legal costs I won against the Council in the original case. These costs should therefore show up in the results of the above FOI request.

Dear Mr Smith,
Thank you for confirming the Council carried out actions in a Court
of Law without having any official policy whatsoever to do so.
As I mentioned in the final paragraph of my original request, since
edited by this website at the Council's request, I therefore
require a copy of whatever due process was taken before the Council
decided to embark on this course of action. I.E. minutes of any
meetings in which the matter was discussed / voted upon / decided -
which is as far as I am aware the only way decisions such as this
could have been legitimately made by the Council, given your
confirmation that the Council has no official policy to carry out
said actions.
Should it be the case that no meetings took place, and in fact the
decisions on what action to take were made autonomously by one or
more Elected Council Members or Council Officers, a statement to
that effect (identifying those people responsible) would suffice to
answer my request for information.

Dear Mr Smith,
Continually accusing me of being "vexatious" is NOT a valid excuse
for you to continue breaking the Law.
YOU carried out actions against me, all I have asked is for a copy
of what policy the Council carried these actions out under, or if
there was no policy (as you have confirmed to be the case) then WHO
decided to carry out unlawful, and quite probably illegal, actions
against me.
That is NOT a vexatious request, it is a request for information
from your records - IE WHO made the decision to carry out actions
against me if it wasn't the Council's Policy to do so.
I demand an internal review, which I have no doubt you will use as
a further excuse to waste more time and not actually do anything as
per usual - however that is the process before reporting you yet
again to the Information Commissioner for your flagrant abuse of
the Law.
Your continued abuse of the Law is costing the local taxpayer
hundreds, probably thousands, of pounds in time costs of staff,
correspondence etc. - all of which will be required to be accounted
for in a future FOI request, at such times as the Council decides
it is going to act within the Law.
Let us be quite clear, it is YOU who is the vexatious party, not I
- as is quite clear to anyone viewing the list of requests to Conwy
Council on this site, and your continued desperate attempts to
prevent the truth getting out to the public.

Mr Smith,
Again you accuse me in public of being "obsessive and vexatious" -
your libellous statement has been forwarded to my Lawyers for
actioning in due course.
Again, the only people being vexatious are you and your
co-conspiritors at Conwy County Borough Council.
It is NOT in any way vexatious or obsessive to ask for a copy of
the information which shows who decided to carry out unlawful &
illegal actions against me where you have already confirmed that
the Council itself had no policy whatsoever so to do.
Naturally, yet another formal complaint has been made to the
information commissioner, with a request they now launch a
prosecution against you for your continued refusal to comply with
the Freedom of Information Act.

While I am aware the above redactions may look bad I believe they are preferable to removing the thread. I believe the essence of the request remains visible. In removing the content from public view I am not taking any view on the truth what has been said, I am merely acting in the interests of WhatDoTheyKnow.com and mySociety.
The council have advised us that this user's correspondence is being responded to, but not via WhatDoTheyKnow.
