I would like to request a complete list of suppliers/contractors
and consultants that have been used over the past year when
procuring IT Software and the total spend on IT Software during the
past financial year.

Also could you break this Software spend down
to show which department uses which application.

Please also provide details of IT Contracts Managers and any
person(s) involved in IT Software procurement.

Dear Mr Fitzsimons

Thank you for your recent Freedom of Information request relating to the
Council's procurement and spend on I.T software. On this occasion I can
confirm that this Council does not hold the information that you are
seeking.

In 2007 Somerset County Council joined the Southwest One partnership
(along with Taunton Deane Borough Council, Avon and Somerset Police
Constabulary and IBM). When this Joint Venture was formed the
responsibility for our I.T service was transferred to Southwest One.

As you may be aware, Southwest One is a publically listed company and not
required to furnish information under the terms of the Freedom of
Information Act in the same way that Local Government Organisations (such
as Somerset County Council) are.

If you would like to find out more information about Southwest One, please

In this case the I.T function has been novated out and is therefore under
the management of Southwest One.

I am able to tell you that the length of the contract with Southwest One
is for 10 years, with the contract running initially until 01/11/17, and
that Southwest One provides the provisions for this service as this is a
term of the agreement between the County Council and Southwest One.
Somerset County Council, Taunton Deane Borough Council and Avon and
Somerset Police Constabulary signed the contract to create a new Joint
Venture company with global business service provider, IBM, at a total
value of approximately £400 million over the 10 year contract period.
Over the course of the contract, Southwest one will deliver to the
Council: Finance, Information and Communication Technology, Human
Resources, Somerset Staffing, Somerset Direct and Customer Services,
Property Services, Facilities Management, Design and Print, Postal
Services and Procurement

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal Review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to Neil Pack

Is there a contradiction here about whether or not Southwest One can, or is required, to provide information under FOI Act?

"Sorry if there is a misunderstanding re your FOI request. This hasindeed been logged with Somerset County Council's Freedom Of Information Department and will be responded to within the 20 working days as previously stated under a case number of 1137442. I think the misunderstanding may because of our address as although we are part of Somerset County Council our office is based in Taunton Deane as part of the Southwest One partnership"

It looks like they've outsourced the FOI handling process to SouthWestOne...

If they refuse to provide any info by saying that the info is held by SWO, and that SWO is not subject to the FOI Act, it may be the case that this is incorrect if the information is held by an outsourced function that would normally be done by the council.

The FOI Act also covers "information held on behalf of a public authority" - see http://foiwiki.com/foiwiki/index.php/Hel...

In addition, the council should disclose much financial information, contracts etc to justify expenditure. as part of its obligations under the Audit Commission Act 1998. http://foiwiki.com/foiwiki/index.php/FOI...

just to add that it is likely that some "real" departments or committees of the Council itself could hold some of this information - eg Scrutiny / Oversight or Audit Committees
