Dear Sir or Madam,
I write under the Freedom of Information Act asking you where the
council keeps its vehicles overnight, i.e. outside working hours.
Additionally I would be grateful of a copy of the council's Goods
Vehicle Operator's License.
Vehicle registration BN58 WDP is currently parked in a residential
street, outside the council's area, where parking restrictions
apply between certain hours. As this vehicle is parked on a
residential street outside the county, presumably for use by an
employee, could you please provide information or policies
regarding personal use of council vehicles along with details of
its application to employment TAX (taxable benefit).

Dear Sir/Madam,
I refer to your request for information regarding Council vehicles,
which was received on 19th October, 2009 and has been dealt with under
the Freedom of Information Act 2000.
The specific information you requested was as follows:
1. I write under the Freedom of Information Act asking you where the
council keeps its vehicles overnight, i.e. outside working hours.
2. Additionally I would be grateful of a copy of the council's Goods
Vehicle Operator's License.
3. Vehicle registration BN58 WDP is currently parked in a residential
street, outside the council's area, where parking restrictions apply
between certain hours. As this vehicle is parked on a residential street

Details of where the Council keeps its Heavy Goods Vehicles (HGVs) are
already published on the Vehicle & Operator Services Agency (VOSA)

Under Section 21 of the Act, a public authority is not obliged to
provide information where it is already reasonably accessible to the
applicant, which in the case of your request is via a website as
detailed above.
A copy of our operator's licence is attached.
The driver of this vehicle you refer to is authorised to take the
vehicle to their home. This allows the operative either to go direct to
site, or finish from site each day.
The vehicle is a 3.5 tonne tipper and therefore falls outside the scope
of the operator's licence in terms of where it can be parked (the
operating centre). The operators licence is only concerned with
vehicles classed as HGV and the vehicle you refer to is not in this
class. Therefore, vehicles not classed as HGV may be parked, for
example, on the highway outside of operatives homes, provided they do
not cause an obstruction.

Whilst not required of me under the Act, I would also explain that in
terms of taxable benefit, employees are exempt by virtue of the fact
that the van is not used for private journeys other than the journey
from home to work.
As I am not providing information which is already published, please
consider this email to be a formal notice of refusal under Section 17 of
the Act.
