COST OF COURT CASES AGAINST VICTORIA PIER

Dear Sir or Madam,

Due to you informing me that due to the Data Protection act you
cannot inform me how much has been spent on court and other costs
in the legal battle against Victoria Pier and its owner, I have an
enquiry that will not infringe on the owners or your own rights,
this should be straight forward to answer as I and other taxpayers
know neither amount in question-

1) The Owner of Victoria Pier, Colwyn Bay or the company managing
it was served with a bankruptcy petition for the amount of
£............(A) due to alleged unpaid business rates/council tax.

2)The amount spent by the council trying to serve the bankruptcy
petition on the above (ALL monies spent for example but not limited
to Court costs, Solicitors/Legal fees etc) is the amount of
£.........(B).

I am not asking for exact amounts or any details just one question
which you give a straightfoward answer to as it will be recorded
information held by your accounts department.

Which is the greater amount A or B?

Dear Mr Hall

The Information Commissioner has decreed that the information you request below is to be considered as 'personal data' relative to the Pier owner. To this end the requirements of the Data Protection Act in relation to the Pier owner must be observed in addition to those of the Freedom of Information Act.

You have been advised due considerations are to take place and you will be advised accordingly. No further communications will be entered into on this subject.

Dear Info Regs Unit,

Please pass this on to the person who conducts personal reviews,
this IS a request for recorded information and under NO
circumstances does it infrige on the Victoria Pier owners personal
data as no personal figures/data are given out. It is my right to
know as a taxpayer how MY money is spent by yourselves. Even though
your refusal to answer points to the fact that the answer is what I
think it is. You have stated no further communication but as you
see I am requesting an internal review, If I do not recieve
acknowledgement of this within 48 hours a complaint shall be made
to the Information Commisioners Office.

Well, that's a LIE for a start, according to the figures I have here on my desk from the Insolvency Practitioner... then there's the 100's of hours the Council has spent internally on the case - as they claimed IN COURT... or perhaps they are admitting to committing perjury yet again by once more having told complete lies to a Judge in a Court of Law? Interesting...

I think we'd best see a copy of the advice from the ICO that Mr Smith refers to (which is presumably the ICO telling the Council once more that they MUST comply with the Law!)
