Dear Sue Moffatt,
Thank you for the interim response to my 20 October FOI request for
the contract and details relating to the police crime map.
I look forward to the issues over disclosure of the contract signed
with RKH being resolved in due course.
I do not expect Section 31 (Law enforcement) to be engaged as I do
not believe the system contains any sensitive information that
would make it a special target. Indeed, I would expect the website
to merely be a presentation of public statistics that are available
elsewhere in government reports in a less user-friendly form.
I do not expect Section 43 (Commercial interests) to apply if the
contract refers to the use of industry standard software available
to any other software companies. The commercial income due to RKH
from NPIA is unlikely to be threatened by disclosure of information
already known to the NPIA procurement unit -- which has authority
over the commercial payments.
For clarification, the "Terms of service" when applied to the
delivery of an on-line product such as this usually defines the
minimum up-times, response times, and quality of the data. It may
be part of the initial contract, or recorded in a separate
agreement. I would expect it to be something along the lines of:
"The website must be available 98% of the day, respond within 10
seconds of a user typing in their postcode, and be updated within 3
days of any police force publishing their statistics."
Such agreements are essential for obtaining a refund or
compensation if the contracted service is not supplied to the
appropriate standard.
