Information reviews.
I am writing to request an internal review of Camden Borough
Council's handling of my FOI request 'Correspondence regarding
motorcycle parking'.
I am still waiting for a reply to my FOI request, which is long
overdue and, in addition to receiving a response to my request, I
demand a full explanation for the severe and unacceptable delay in
answering this FOI.

Engineers with the Engineering Service and hopefully I shall have some
feedback tomorrow.
Unfortunately your request was initially sent to Parking Services who
failed to pass it onto yourselves within 20 working day timeline. So, as
mentioned earlier, hopefully I can obtain the information requested and
forward that to you tomorrow afternoon (Friday 18 February 2010).

The request was refused on the grounds that the information is available
on Camden's website to which a direct link to where the information is
held.
In reference to your appeal, I merely referred you to the point of
contact for Camden's Freedom of Information Appeals Panel if you are
dissatisfied with Camden's response; this is also mentioned in the
response sent to yourself. I never implied that you cannot do this
through www.whatdotheyknow.com.

Dear Shawn Alexis,
So all in all, it took the council almost 3 months to issue a
refusal notice to this FOI. Not only did you ignore the FOI during
the statutory 20 working days and, when chased, you advised that
you were looking into it to finally advise today that the request
has been refused.
I have asked for copies of ALL correspondence whether sent or
received and internal or external (emails, letters, memos etc), by
Councillor Chris Knight and the council's parking department
regarding motorcycle parking since 1st January 2009. You are now
telling me that this information is available on the council's
website. Are you implying that you are publishing ALL
correspondence sent and received from and by Council staff on your
website?
Please provide the specific links to the council's website where
copies of ALL correspondence I am after is available, as you have
failed to do so on your response today. I have looked and can't
find anything.
I am also waiting for your internal review, which I am perfectly
entitled to request via the www.whatdotheyknow.com website.
If I haven't heard back from you within 24 hours from the date and
time of this email with the links to the council's website where
ALL the correspondence requested is available, I will refer the
matter to the Information Commissioner for failure to provide the
information requested within the timeframe allowed by the Freedom
of Information Act 2000. I will also refer the case to the ICO for
failure to provide an adequate and appropriate reason for your
decision to refuse this FOI request.
The way the council has handled this FOI request so far is totally
unacceptable.

The information supplied on the Drury Lane improvements do contain a reference to a reduction in size of an existing motorcycle parking pay. Turning over the space to a relocated 'car club' bay. So this is a disclosure of related information but hardly amounts to satisfying your FOI request.

I believe the Council has something to hide and this is the reason why they are so reluctant to reply. They have come up with a complete invalid reason to refuse this FOI request. Not only have they sat on the request for a long time (a lot longer than the statutory 20 working days allowed by the law), but in addition they have messed me around with fob-off responses and invalid excuses. The case is about to be referred to the Information Commissioner for full investigation, as the Council has clearly ignored the requirements of the Freedom of Information Act 2000.

Dear Mr Swingler,
Thank you for your internal review regarding the above FOI request.
The link that I was given is this:

and I can't see how it provides the information I initially
requested. The page is to do with Drury Lane pedestrian
improvements, therefore would you please explain how this relates
to motorcycle parking and, moreover, provides copies of the
correspondence relating to motorcycle parking that I requested.
The ICO have today replied to my complaint and I have a copy of the
letter they sent you. They have advised me to contact them again
should I not receive a satisfactory response to my FOI request,
which I intend to do if I have not received clarification from you
within 10 working days from today.

There has clearly been discussions within Camden Council about motorcycle parking and this link proves it: http://forum.notobikeparkingtax.com/camd...
I'm sure there has been a lot of communication about motorcycle parking in Camden since 1 January 2009 but it can't be found on the council's website so the information is NOT accessible by other means therefore the reason given for refusing to provide the requested information is invalid!
We can only hope that the No To The Bike Parking Tax campaign looks into the planned Camden motorcycle parking charges as something seems a bit dodgy to me. http://www.notothebikeparkingtax.com/
