contain the BERR logo but our new BIS logo. It also contained a
confirmation of your Freedom of Information request.

Thank you for your request for information relating to correspondence
between Patrica Hewitt MP and the Department for Business, Innovation and
Skills (formerly BERR).
I apologise for not responding within the published timescale.
Having interrogated the Department's correspondence system, I find that we
have received 111 letters in total from Patricia Hewitt. All of these
letters were written in her capacity as Member of Parliament for Leicester
West and contain personal data about her constituents, which we are
withholding under section 40 (2) of the FOI Act, Section 40 is an absolute
exemption and therefore does not require a public interest test.
We are also unable to disclose the information under section 41 of the FOI
Act as the disclosure of such information would constitute an actionable
breach of confidence.
We consider that the some of the information was provided to us under an
implied duty of confidence. Treating this information as subject to a duty
of confidence is also consistent with the general practice of the
Department. In considering whether disclosure of this information would
constitute an actionable breach of confidence we have considered whether
there is a public interest in disclosing the information. We have
considered whether disclosure would lead to greater transparency in
relation to the reporting process and whether it would increase the
accountability of government in relation to the use of public funds.
However, we also need to consider the interests of the persons who
provided the information and to whom a duty of confidence is owed. Having
considered these factors, we have decided to withhold said information
under the two exemptions.
