Please provide this information for the last 5 years. I understand
from my previous FOI request, that 13 complaints of homophobia,
have been made over the past 5 years.

Your request will be considered in accordance with the Freedom of
Information Act 2000. You should expect to be sent a response within the
statutory limit of 20 working days, subject to the provisions of the Act.

Dear Lord McDowall,

I write in connection with your request dated March 8, 2009, which was
received by this office on March 9, 2009 requesting the following
information:

Please provide me with a copy of all documents, including emails and
memos; regarding complaints of homophobia against a police officer or
civilian in the forces employ.

Please provide this information for the last 5 years. I understand from my
previous FOI request, that 13 complaints of homophobia, have been made
over the past 5 years.

I can confirm that information falling within the description specified in
your request is held by Devon and Cornwall Constabulary. However, the
cost of providing you with the information is above the amount to which we
are legally required to respond i.e. the cost of locating and retrieving
the information exceeds the `appropriate limit' of 18 hours as set in the
Freedom of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004.

This is because in order to go through the documents we have retrieved
with regard to the 13 complaints and ascertain what is relevant it would
take in excess of 18 hours. Furthermore, in order to find all 'documents,
emails and memos' within the whole force we would have to contact all
members of staff to ask whether they hold any correspondence relevant to
your request, which would take significantly longer than 18 hours.

In accordance with section 12(1) of the Freedom of Information Act 2000
this constabulary is not obliged to respond to your request and this
letter acts as a Refusal Notice for your request.

If you would like to make a new request which narrows the scope of your
current request, we may be able to comply with that request within the
appropriate limit. Should you wish to discuss how to refine your request,
please contact this Unit and we will be happy to assist.

Complaint Rights
You have the right to ask us to review this decision. If you wish us to
review this decision please set out your grounds for review in writing and
send them to the Head of Information Management, Information Management
Department, Devon & Cornwall Constabulary, Middlemoor, Exeter, EX2 7HQ,
Devon.

If you are still dissatisfied after an internal review you also have the
right to appeal to the Information Commissioner at Commissioner's Officer,
Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, telephone 01625
545700.
