(1) Fraud and deception related offences,
(2) Violent offences, including assault,
(3) Drug related offences,
(4) Sexual offences,
(5) Racial, Religious or Homophobic offences

Dear Lord McDowall
I was uneasy to learn about the background to this matter and in the
first instance am replying to advise on the process and circumstances
that appear to be involved in this case.
I have confirmed that the force incoming email servers did in fact
receive your original Freedom of Information (FOI) request (sent
23.03hrs, Fri 3 Oct 2008) but did not then forwarded it on to the Force
Disclosure Unit as our own departmental records and relevant force IT
activity log confirms. As it transpired the Force Disclosure Unit only
became aware of your request on Saturday 1 November 2008 when your
second email was received in our INFO mailbox. In this case your
response would be due at the latest by 1 December 2008 but as you are
aware was answered in full on the first working day, i.e. Monday 3
November.
I am at a loss to know the reason why your original email request was
not processed as normal and have asked for further investigation to be
carried out, however, as relevant records are only retained for a
limited time I doubt a suitable explanation can ever be achieved.
Nevertheless be assured those responsible for administering such systems
are now aware of this matter and the resultant issues surrounding them.
As it stands I can only offer an unreserved apology for the technically
delayed response to this matter and thank you for bringing it to our
attention.
Given the FOI Review process is handled by three senior members of staff
who are completely independent of the FOI response process, I would be
grateful if you could advise me if this explanation suffices for your
understanding of the situation and thus negates the need for such a
Review? If, however, you still wish us to proceed with a formal Review
of your request please revert back to me and I will advise the Panel
members of the above information in which case a response from them will
be sent to you within the prescribed period.

Thank you for your email. I accept that technical problems can
arise and I understand the with all technology, due process can be
delayed.
I am not satisfied that my FOI request has been answered fully. I
would be grateful if the Force Disclosure Unit can look at the
request, and reply fully, addressing all of the questions asked.

Please see the undernoted in reference to those general categories you
mentioned in your request, viz, "Please confirm how many serving
officers in the Strathclyde area, have been convicted of" the following:

4. Sexual offences: Response 0
5. Racial, religious or homophobic offences: Response 0
Our original response did not mention categories 1, 4 and 5 as there
were no relevant recorded convictions relating to serving Strathclyde
Police officers based on your categories.
Offences relating to officers residing in the Strathclyde area but
serving with other forces will have to be requested by you from those
other forces. If you need their FOI contact addresses please let me
know and I will provide them to you, however, all have the relevant
contact information on their own force websites.
I trust this answers your request in full and that you no longer request
a Review?
