Dear Sir or Madam,
At the full Council meeting on 9th Feb., Cllr. Wilkins stated
that, during Jan., a contract had been drawn up with 'the charity',
'Pioneer People' to take over Fisher's Lane Community Centre. He
stated that negotiations/contracts have been completed, in the
matter of the 'transfer' of this community asset.
a) May we have details of contract..e.g Is the building leased or
sold.....
b) What are the financial arrangements/details of the transaction?
c) May the Wirral Public view the contract/transfer details
d) Who are the new representatives for governance/committee...names
please.
e) Knowing that 'Pioneer People' are in fact, 'a Christian church',
what elements/conditions have been written into the contract to
ensure adherence to broad community use/equal opportunity for
use...reflecting the multi faith, multi cultural community of West
Wirral..Wirral in general....How will adherence to the Law be
monitored in order to prevent reinforcement of 'village
mentality'/mono culturalism/ racism?
f)Please define the process by which this business transaction of
'assett transfer' came about...advertising/time scales/ number and
details of applicants for 'deal'

Dear Corrin, Jane,

I am not at all happy with the response to my FOI request re
Fisher's Lane Community Centre...it ignores all my
questions....there is hardly any info there at all...... Seven
eighths of the info is irrelevant and 'surplus'...the final two
paras., the last being one sentence, is skimpy, sketchy and
general...and does not address any of the specific questions I have
answered. I want answers. This is my formal complaint. I wish to
address now to FOI Commissioner.
Please ring me Jane, re. my other request re. correspondence
between PCT/Wirral Borough Council/Warrens...I believe my
answer/response is well outstanding. Thank you, Val Curtis [phone

With regard to Fisher's Lane Community Centre, this is the recorded
information the Council has, I will go back to the section that supplied
the information with your comments and will get back in touch with you
shortly.

The PCT/Warrens request, the majority of the information belongs to the
PCT and we are awaiting decisions from them as to whether they wish to
apply any exemptions under FOI, however I do appreciate the passage of
time and again I will contact the section concerned and get back to you.

Dear Corrin, Jane,

I am now going to make formal complaint re. Wirral Council/West
Wirral PCT's refusal to access/provide this info.

They have well had long enough, and, in addition I have further FOI
complaint, I wrote to Christine Mathieson, practice manager, at
West Wirral Group practice, requesting an appt. regarding their
failure to provide info. requested in January. We asked to meet in
order to be able to clarify our request. I wrote to her on 8th
April, delivering the letter by hand. To date, there has been no
acknowledgement, nor reply.
Thus, we believe all agencies have had adequate time to provide
info. asked for and, by, 'shilly shallying....'stalling', have
failed, under the terms of The FOI Act to conform to democratic
law. We have no choice but to put in complaint to Commissionnaire.
I requested to see you as I am not that efficient with I.T and
would find it easier to sit down, with help and work through
putting together our complaints re. 'the clear avoidance of
forwarding the info. asked for'. Given the background to this
attempt to build on parkland greenbelt, and the legal dept.'s clear
attempts to evade, conceal and confuse the Public, it is of utmost
importance that all matters relating to this attempt to dispose of
village surgery services, and build on parkland greenbelt, are
brought absolutely into the open. All 'authorities' have had long
enough. We now must make formal complaint that they are witholding
and concealing information. THIS MATTER IS RELATED......And
demonstrates the pattern of behaviour by this Council, and
particularly in this locality, of ignoring the
majority.....(Fisher's Lane was one of the Community Assetts listed
under SAR proposals...wghich are under investigation by LGO.., and
this 'deal' was done with indecent haste......contrary to all other
procedures, the body involved having links with the 'group' who
wish to build on Warrens greenbelt parkland.

In addition, Fisher's Lane had been proposed as an 'alternative
site' for the much publicised 'Health Centre/Polyclinic',..thus it
was logical that when it became available through SAR proposal, the
logical course of events would be to offer it up then for PCT
use...a perfect solution........ for the much publicised 'needs' of
PCT.
We are extremely unhappy with the hasty manipulations, concealed
from public scrutiny, by which this 'arrangement/contract' has come
about. The health need should have/should have priority over the
'Pioneer People church need. THEY ARE NOT A CHARITY.
I would also like this info. passed over to the Public
Enquiry/Local Govt. ombudsperson. THANK YOU

The report was exempt and therefore is not available for release under
Freedom of Information provisions.

The actions of the PCT are unfortunately out of our control and they are
a separate public entity under The Freedom of Information Act and act
independently of the Local Council with regard to Freedom of Information
requests.
