Contract between Logica and Barnet

Dear Barnet Borough Council,

Section 7.1 of Agenda Item 7 of the Cabinet Resources Committee
Meeting, 8 November 2004 states:[1]

"7.1 Further to the decisions of the joint meeting of Cabinet ICT
Committee and Cabinet Resources Committee at their meeting of 19
August 2004, a contract (number: 13708) was entered into between
the London Borough of Barnet and LogicaCMG UK Limited on 14 October
2004.[2]"

The aforementioned Cabinet Resources Committee Meeting, 19 August
2004[3] says in Section 4 of the decisions of the joint committee:

"(5) That as the Cabinet Resources Committee has approved the
financial implications as set out above and in the exempt report,
the Assistant Chief Executive be instructed to accept the tender of
the contractor detailed in the Exempt Report, subject to commercial
considerations and approval of all legal documentation by the
Borough Solicitor, to deliver and implement the Modernising Core
Systems Programme and provide a managed service for five years,
with an option to extend for a further three years subject to
performance, following implementation of the core elements of the
new system."[4]

Under the Freedom of Information Act, please may I be sent the
following:

(1) A full copy of the contract (number: 13708) entered into
between the London Borough of Barnet and LogicaCMG UK Limited on 14
October 2004

(2) A full copy of the exempt report provided to the Cabinet
Resources Committee Meeting on 19 August 2004.

The case for the exemption of this report should be reconsidered in
order to satisfy this request owing to the fact that:
(a) a certain amount of the sensitive information (specifically,
the identity of the contractor) was subsequently disclosed,
(b) the contract has now been signed and is legally binding, so
revenue is unlikely to be threatened by disclosure of any
information about it,
(c) Schedule 12A of the Local Government Act 1972 does not list
Freedom of Information Act 2000 when considering the required
disclosure of council information[5]

15 pages from a 300 page contract and no copy of the exempt report. This is a refusal by any other name. What have Barnet got to hide?

Dear Emma Gaydon,

Thank you for the response to the request I made on 8 May 2011 for
the 14 October 2004 contract between Logica and Barnet Borough
Council and the exempt report provided to the Cabinet Resources
Committee Meeting on 19 August 2004.

This response appears to contain only 15 pages from a 300 page
contract and no exempt report.[1]
