Continous Benchmarking of Liverpool Direct contract

Dear Liverpool City Council,

In the Service Provision Agreement between Liverpool City Council
and Liverpool Direct Limited (BT) dated 13 July 2001, clause 5(vi)
of Schedule 22 reads:[1]

"The outcome of Continuous Benchmarking shall be the production of
quarterly monitoring information in accordance with the reporting
deliverables described in paragraph 2.9 of Schedule 9 Service
Management and an annual Continuous Benchmarking report detailing
the financial and service performance of the Services that shall be
considered by the Contact Manager and the Project Director. The
production of the annual Continual Benchmarking report will be such
to enable it to be taken into account as part of the Annual Review
and the Service Improvement Plans."

Please may I be sent:

(1) Copies of all such annual Continuous Benchmarking reports
produced since the contract was signed.

(2) Any notices of complaint by the council concerning the delay,
inadequacies or lack of such a report in any one year.

(3) Whether there were any consequences for LDL as a result of any
non-compliance with clause 5(vi).

I am making this request in order to verify the claim made in a
disclosure by the Liverpool Echo[2] that very few of these reports
were actually produced.

Dear Kevin Symm,

Thank you for your letter of 1 November confirming to me that
Liverpool City Council has received only one "annual Continuous
Benchmarking report" from LDL in nine years, yet has never issued
any notices of complaint.

Please consider this letter as a request for an internal review
over the determination that providing me with a copy of this single
report is exempt under Section 41.

The contract stipulating the existence of these reports states that
they shall be considered by the Contact Manager and the Project
Director, but provides no indication that it is confidential.

Please send me a full copy of this report with exempt information
blocked out, as is standard practice.
