Mr Carroll made this Freedom of Information request to Sandwell Metropolitan Borough Council
The request was successful.
From: Mr Carroll
14 November 2010
Dear Sandwell Borough Council,
I am writing to make an open government request for all the
information to which I am entitled under the freedom of information
act and the environmental information regulations.
In order to assist you with this request, I am outlining my query
as specifically as possible.
If however this request is too wide or too unclear, I would be
grateful if you could contact me as I understand that under the
act, you are required to advise and assist requesters.
Please provide by electronic means a full list of sites in Sandwell
designated as "contaminated land" and an explanation of your
inspection strategy for potentially contaminated sites and a list
of these also. Please also provide a list of sites designated as
"special sites".
In the site allocations delivery development plan, do you intend to
submit any potential areas set aside for housing development areas
without having first carried out an assessment of such land as
"contaminated land", which could leave the council with significant
future liabilities?
Therefore should the inspection strategy for identifying
contaminated land come before such a document is put out for
"public consultation"?
I understand that under the act, I should be entitled to a response
within 20 working days.
I would be grateful if you could confirm that you have received
this request. I look forward to hearing from you in the near
future.
Yours faithfully,
Mr Carroll

This contaminated land regime is deeply flawed legislation and needs reform- currently it only serves the dodgy brick builders and the industrial polluters who never pay, certainly NOT THE ENVIRONMENT IT IS SUPPOSED TO PROTECT.
If you are an MP reading this, do something about it, unless you have fingers in the pie concerning policy advise to the house building industry!
