Consumer Protection - legal exclusion of financial services industry

Sheila Gibb made this Freedom of Information request to Her Majesty’s Treasury

The request was refused by Her Majesty’s Treasury.

From: Sheila Gibb

4 September 2009

Dear Sir or Madam,

Could the Treasury confirm the existence of SI 2000 2334 Consumer
Protection (Distance Selling).... which specifically EXCLUDES any
protection whatsoever for distance consumers of the UK financial
services industry. (A NON- EXHAUSTIVE list of such financial
services being supplied in schedule 2.)

Could the Treasury please confirm that this was written by civil
servants and those in the Treasury. And could the Treasury please
advise me a distance consumer of the UK finance industry 1990-2008
WHY every last man jack in this country, (including the FSA / FOS,
DTI and indeed the Complaints Commissioner) is under the delusion
that I have been entitled to "consumer protection".

This "law" could explain WHY everyone in this "Member State" is
STEALING all of my ASSETS (including my home courtesy of this
absurd new Housing Act, England & Wales). Or perhaps they are under
the impression due to one comment in this Instrumnent that I am
"gifting" everything for which I have strived over 30 years to
criminals in the UK finance industry and now to local public
servants (local councils).

Yours faithfully,

Sheila Gibb

Dear responses, FOI,

Thank you for this response. I have several questions here:

1. WHY did it take the Treasury until 2004 to implement legislation
re distance consumers? It can introduce 2005/60 in 2003 whereby
this EXCLUDES existing consumers now distant from any ability to
DEFEND their legally acquired wealth and property in the UK as a
consequence of seeking employment overseas at the insistence of the
government(s).

2. WHERE in law is the provision for consumer protection for
EXISTING consumers prior to 2004 who have since 2002/3 become
NON-PERSONs as they are NOT resident at a UK address? SI 2004/ 2995
ONLY covers NEW BUSINESS / CONSUMERS since October 2004.

3. As a British citizen now a skilled independent mobile worker
since 1900 and BEFORE the introduction of money laundering
regulations (93/308 & 2005/60)and 2002/65 (SI 2004/2995)I have NO
consumer protection, NO CHOICE and NO means to DEFEND my legally
acquired wealth / property. THIS COULD BE WHY ALL AND SUNDRY ARE
NICKING ALL OF MY ASSETS MOVABLE AND IMMOVABLE COURTESY OF THIS
ABSURD NEW HOUSING ACT (ENGLAND & WALES).

I draw your specific attention to the securities of my endowment
SOLD OFF 2001-3 and thus I have NO PROTECTION WHATSOEVER, NO MEANS
TO EMPLOY A LAWYER FOR REDRESS and NO LIFE!!!!!!!

4. WHERE is the consumer protection for EXISTING DISTANCE CONSUMERS
as opposed to NEW consumers that are "distant"?

5 And could anyone EXPLAIN HOW my "business" (but NOT my assets)
are transferred into an Insurance Intermediary to which I have
NEVER contracted ANY BUSINESS but I AM A FINANCIAL CRIMINAL FUNDING
TERRORISM (Objective 15 /2005/60)?

6. My "business was transferred to a finite notional holding
company but ASSETS were transferred INTO THE POCKETS OF STAFF.
OBJECTIVE 34 2005/60 MAINTAINS THIS IS NOT MONEY LAUNDERING!!!!!!!
COULD THE TREASURY CLARIFY JUST EXACTLY WHAT "CRIME" THIS IS?

Yours sincerely,

Sheila Gibb

Dear responses, FOI,

Given the "timing" of the introduction of various pieces of "law"
that formed part of the Eu Finanical Services Plan to which the
Treasury was a main party (Sir Nigel Wicks, diretor of Euroclear)
and indeed consumer protection law I would like an answer to this
email on behalf of ALL EXISTING DISTANCE CONSUMERS with endowments
of which there are a mere 2 million at Standard Life alone. (Across
the sector I would hazard an educated guess at distance consumers
equating to the total population of Scotland!)

Distance consumers PRIOR to 2004 have NO consumer protection and NO
means to DEFEND their LEGITIMATE WEALTH / PROPERTY and thus WE are
being MERCILESSLY EXPLOITED by a WIDE RANGE OF ORGANISATIONS both
public and private.

I believe this unsavoury state of affairs deserves an answer.

Yours sincerely,

Sheila Gibb

Sheila

As we have explained in previous communications with you, the Freedom of Information Act 2000 provides a right of access to recorded information; we do not see any way to address your sense of grievance under that Act. Thank you nonetheless for continuing to take the time to put forward your views, which we have noted for the record.
