Dear Sir or Madam,
Please could you provide the following information:
a) Is the Construction Helpline/Hotline service still being
provided by Springboard Marketing?
b) How much has the provision of the service cost to date?
c) Who handles the calls and where are they located?
d) A copy of the log of all calls taken to date. Personal
information eg. contact details of the caller can be excluded; I am
interested in the dates/times, subject of call and response
provided if available.
e) Copies of any routine reports or statistical summaries produced
to date on the usage of the Construction Helpline.

Dear Ms Jarvis,
Thank for your response of 22 July 2009 and the efforts made so far
to provide the information requested.
I am sorry that the provision of the information has proven so time
consuming - however I believe the ODA is mistaken in including the
time taken to review the call log records and redact any personal
details in calculating the overall cost.
The response states
"3.Extracting the information from the documents containing it
(including editing): £325 (about 13 hours at £25.00 per hour)."
It appears that this consists of time spent examining the documents
and removing any personal information in the interests of Data
Protection ie. section 40 exemption - this should be excluded from
the costing.
This is made clear in the Information Commissioner's procedural
guidance notes 'Using the Fees Regulations', available at
http://www.ico.gov.uk/what_we_cover/free...
Page 3 explains
"Exempt information - Once the documentation containing the
information has been located and retrieved, a public authority
cannot take into account the time taken, or likely to be taken, to
consider whether any of the requested information is exempt. Nor
can it take into account the time taken, or likely to be taken, to
remove the exempt information in order to leave the information
that is to be disclosed in response to the request. The activity
"extracting the information from a document containing it" refers
to the extraction of the information that has been requested out of
a document which contains other information, not to the extraction
of exempt material from the information that has been requested.
This was confirmed by the Information Tribunal in the case of
Jenkins v Information Commissioner and Department for Environment,
Food and Rural Affairs (EA/2006/0067; 2 November 2007) and
subsequently endorsed by the Tribunal in the case of DBERR v
Information Commissioner and Friends of the Earth (EA/2007/0072; 29
April 2008)."
Additionally in the guidance notes 'Redacting and extracting
information' on pages 2 & 3 it states that a public authority is
not permitted to take into account:
" - any costs resulting from the time spent by its staff or others
working for it in handling the request;
- The actual or anticipated costs of the time spent in considering
exemptions; and
- redacting exempt material."
Unfortunately I am unclear what this phrase in the response means:
"Since the cost of complying with your request exceeds the
appropriate cost limit, we are refusing that to provide you with
the Item 4 information which you have requested for the period from
the inception of the Construction Hotline up to 31 December 2008."
Does it mean that only 2009 information would be supplied, with the
remainder withheld on grounds of the cost of editing out exempt
material? If so I do not find it acceptable for the reasons given
above, and I must insist on all the requested information being
supplied.
However I am happy if the information is supplied in batches as the
checking is completed.

dated 11th August we advised you that we would endeavour to provide you
