Consent to contact third party employers not a Data Protection Act requirement
Ian Wolf made this Freedom of Information request to Department for Work and Pensions
The request was partially successful.
From: Ian Wolf
26 December 2011
Dear Department for Work and Pensions,
On the Jobseekers Agreement form ES3JP it contains the statement:
"I understand Jobcentre Plus may seek
feedback from employers about any
jobs they have told me to apply for."
Please provide internal information held that confirms that the DWP
do not have to comply with the Data Protection Act or need the
fully informed and freely given consent of it's customers to
contact a third party for personal information (feedback), such as
asking "employers about any jobs" you required them to apply for?
Please provide internal information held that this infraction of
the Data Protection Act is permitted and whether a customer can
withhold or withdraw consent to contact employers for "feedack"
"about any jobs" you have required them to apply for?
Please provide internal information held that explains how a
customer can explicitly refuse to give consent to allow such
contact with employers (third parties) and when they do
refuse or withdraw existing consent will not affect any benefit
they may be entitled to?
Please provide copies of internal information held that confirms
that DWP policies and regulations on Consent and the Data
Protection Act do not apply to the Jobseekers Agreement form ES3JP?
Yours faithfully,
Ian Wolf
