Dear Sirs,
Please provide full details of:
1. The Authority's policy in respect of participation by senior
police officers by way of vested-interest shareholdings in private
limited companies which actively deal in matters which concern day
to day operational policing.
2. Whether and on which dates the Authority has studied the
implications including conflict of interest implications of the
shareholdings held by senior Devon & Cornwall Constabulary (D&CC)
police officers in ACPO (the Association of Chief Police Officers),
a private limited company, which sells for valuable consideration
Sensitive Personal Data (SPD) harvested by D&CC as an inseparable
part of any official or unofficial arrest policy.
3. Control(s) exercised by the Authority in respect of advice
sought and received from their private limited company ACPO by
senior D&CC police officers and implemented into operational
policy.
4. Control(s) exercised by the Authority in respect of determining
and imposing the sources of legal and policy advice upon which
senior police officers of D&CC may rely in the formulation and
implementation of operational policing methods and policy.
5. If the Authority has not considered the potential conflict of
interest implications and the effect upon the unlawful enrichment
of ACPO of the implementation (official or unofficial) of excessive
resort to unnecessary arrest in order to harvest SPD which is the
predictable outcome of such vested-interest shareholdings, what are
the reasons for not acting in the public interest by preventing
senior police officers from participating in the private company
ACPO?

ACPO to include all/any subsidiaries (eg ACPO Criminal Records
Office etc), affiliates and associates whatsoever, and/or any other
organisations of a similar nature whose activities might conflict
with the proper and proportionate exercise of operational
discretion as necessary in a democratic society.

I am emailing in response to your request, made by email, on 5 November
2010 to undertake an internal review of the response to your Freedom Of
Information request, namely that the Authority does not hold the
information about conflicts of interest: vested interest Shareholdings by
Senior Police Officers (email sent to you on 5 November 2010). I am sorry
for the delay in providing this response.
Internal Review Outcome
I have conducted an independent review of the response to your request and
the outcome is to support the original decision - that is the Police
Authority does not hold the information that you have requested.
Complaints to the Information Commissioner
If you are not satisfied with this response a complaint can be made to the
Information Commissioner's Office by the Requesting Party.
As per section 50 of the Freedom of Information Act, the Commissioner
expects complainants to have exhausted the public authority's internal
complaints procedure before submitting a complaint. This is known as the
"internal review". This review has been conducted and the outcome is to
support the original decision to refuse the information request, as
detailed above. We will be discussing the issues raised in the request
with the Chair of the Professional Standards Committee to determine any
learning points for The Authority.
