Confiscated Red Diesel

Dear HM Revenue & Customs,
This is a reply from VOSA.
VOSA does not check for or confiscate "red diesel" found when
inspecting vehicles. However we do sometimes take part in multi
agency checks which may include officers from Revenue and Customs,
who do check for this. I would therefore suggest that you direct
your request to HM Revenue and Customs who may be able to help you
in respect of this request.

My request to HM Customs is for information on what happens to red
diesel when confiscated from people and cars when used unlawfully,
the chain of events from confiscation to disposal of red diesel.
What is the procedure, does HM Revenue make any money from this
apart from the fines it may impose.

Dear Mr Toomer

Where the seized fuel can be used (which is by no means in all cases, as
it is often contaminated and cannot be put to an acceptable use) it will
be sold on and the monies paid are returned to the Treasury: HMRC does
not obtain any financial gain from the goods. Where it cannot be sold
on, it is denatured (for example, by deposit in bulk tanks along with
sludge, used oil etc) and then destroyed in an approved fashion.

The chain of events is:

if found in a vehicle which is to be restored to the owner, they are
told in writing they must take the vehicle to a garage and have the tank
cleaned out;

if found in bulk, the fuel will be removed by our contractor and taken
to their secure approved premises, where it will either be stored
pending any appeal, review or prosecution, and eventually destroyed or
put to an acceptable use on payment of the required amount of money.
