Confidentiality.
Arthur Peasgill made this Freedom of Information request to General Social Care Council
The request was partially successful.
From: Arthur Peasgill
23 February 2009
Dear Sir or Madam,
I make this request under the Freedom of Information Act 2000.
I am interested in the obligations of Social Workers to
client/service user confidentiality.
Can you please send me any policies/procedures applicable to Social
workers and confidentiality?
Are Social Workers under a legal obligation to always respect
client/service user confidentiality unless there are good reasons
to not do so?
What are the reasons when obligations of confidentiality can be
ignored?
Are there any sanctions available to the GSCC to bring disciplinary
action against registered Social Workers if confidentialities are
breached?
Does the GSCC regard the client/ Social Worker relationship to
always be a confidential one?
Are Social Workers subject to a Code of Conduct governing their
obligations to client confidentiality?
Please provide this Code of Conduct.
Yours faithfully,
Arthur Peasgill

Dear Sir or Madam,
Can the GSCC please respond to this request? The GSCC as a public
body cannot be seen to be setting standards of conduct properly, as
regards a profession generally in public disrepute, when at the
same time acting unlawfully itself. Recent disasters partly
attributed to serious failures by Social Workers in Haringey,
Doncaster, Birmingham, Vale of Glamorgan etc, etc, etc will be
partly understood if their overall "watchdog" body acts unlawfully
as well.
Yours sincerely,
Arthur Peasgill

Dear Mr Peasgill
Please find attached a copy of the GSCC Codes of Practice governing
social workers' obligations to client confidentiality.
I also refer you to the GSCC Conduct Rules 2008, which deal with powers
available to a conduct committee when determining sanctions. This
document is published on the GSCC website:

Please note that the GSCC cannot provide specific advice in relation to
particular scenario and therefore you should seek independent legal
advice if you want further information.
Kind regards
Rupinder
