Dear Department for Work and Pensions,

I have recently been kicked off of Incapacity Benefit despite my
diagnosis of severe mental illness due to the sham WCA medical
examination. When having bad days I need to stay away from people
as I am likely to lash out I do not consider that this will be
possible due to your awarding me zero points in the sham WCA.

I have no wish to discuss my medical problems or history with
anyone other than a qualified doctor, neither do I wish to discuss
my criminal record with anyone.

I would like to request the information you have which sets out
your requirements, and my legal rights, in these 2 areas relating
to my personal data, including specific listing of what medical
information I am legally required to divulge to DWP and JCP staff (
other than qualified medical practitioners) Work Providers ( other
than qualified medical practitioners) prospective employers( other
than qualified medical practitioners) and anyone else involved. And
a specific listing of who I am required by law to supply details of
my criminal convictions to.

Please also supply details of the specific legislation that your
response is based upon.

You may want to consider, Insurance Codes of practice.
An employers Insurance may not cover certain medical conditions. The Department for Work and Pensions, have an obligation to consider if they are creating Liabilities against potential employers.
I knew of a young man who was un-diagnosed Aspergers, he was nearly killed in the work place, due to him not recognising the requirement under health and safety to wear protective clothing. He was working with electrics and sustained serious injuries and burns.

Dear Department for Work and Pensions,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Department for Work
and Pensions's handling of my FOI request 'Confidential information
regarding diagnosis, medical history, and criminal record'.

Your response has fudged the issue of the information I have
lawfully requested and therefore you have not supplied that
information.

Your response mainly deals with reassessment of IB/ESA this was not
what I requested:

I stated: ' what medical information I am legally required to
divulge to DWP and JCP staff (other than qualified medical
practitioners) Work Providers (other than qualified medical
practitioners) prospective employers (other than qualified medical
practitioners) and anyone else involved'

I made it clear that the assessment process was completed, my
request was concerning what (highly confidential) medical
information I have to, by law, divulge to Jobcentre Staff, DWP
staff, Work providers etc who hold no medical qualifications.

I suggest you read the request before responding in future as this
is your job and you are funded through the public purse to carry
that out in a competent fashion and in compliance with the
legislation concerning FOI requests. Please supply the information
I have requested at your earliest convenience or I will forward a
complaint to the ICO without further delay.
