Response to this request is long overdue. By law, under all circumstances, Warwick District Council should have responded by now (details). You can complain by requesting an internal review.

Dear Warwick District Council,

I have been told verbally that investigations leading to possible
planning enforcement action at my property prior to my ownership
where concluded, with decisions reached within the planning
department enforcement section. Despite reviewing enforcement
activity i can see no such conclusions at all. Therefore i would
request all records showing the conclusions and recommendations
based upon enquiries which we know took place, to be revealed.
This is information is critical for any forthcoming appeal as it
could possibly identify serious deficiencies in the authorities
processes.

Dear Mr Webb

Thank you for your request for information which I acknowledge was
received by the District Council on Monday 14^th March 2010.

Your request is currently being considered. If the District Council is
able to provide you with the information you have requested, then under
the Freedom Of Information Act you are entitled to receive it within 20
working days.

For your information, the FOI Act defines a number of exemptions which may
prevent release of some or all of the information you have requested. The
District Council will assess your information request in light of the
exemptions. If exemptions do apply, then the District Council may decide
not to release all, or part, of the information you have requested. You

Dear Mr. Webb,

Further to your recent request, I have reviewed the information that was despatched to you in December 2010 from the District Council's Planning Enforcement files. Your request at that time specifically related to investigations of residential occupation at the property in question and copies of information from the following files was despatched to you.

1. 1998: Investigation reference 323/9/98: the use of stables as a dwelling.
2. 1998: Investigation reference 407/12/98: the use of stables as a dwelling.
3. 2001: Investigation reference 166/6/01: the occupation of stables.

The information sent to you included the case notes hand written by the investigating officer which included the conclusions reached. As you are aware those notes are currently being transcribed for you and a typed copy will be forwarded as quickly as possible which I anticipate will assist in your clarification of those considerations.

As indicated in my response to your earlier request, there have also been 2 other investigations at this site as follows:-

1. 2002: Investigation reference 48252/02: the condition and visual appearance the site.
2. 2006: Investigation reference 415/40/06: the erection of a walled/gated site entrance and an area of hard standing.

Those investigations did not relate to allegations of residential occupation at the site. I did however despatch to you any information from those files relating to that allegation. The case notes and outcome of those investigations was not included because they did not make reference to the consideration of residential occupation.

On the basis that your request continues to relate to information from our files relating to allegations of residential occupation, I have not identified any further relevant documentation. I will however be despatching typed transcripts of the hand written case notes referred to above as quickly as possible.
