Dear Sir or Madam,
I would like to make a request as regards to the concessionary
travel arrangements in your authority under the terms of Freedom of
Information Act.
1. Does your authority provide concessionary travel passes to those
individuals registered with their local Social Services department
as disabled on the grounds of being a mental health user or
survivor?
2. If your authority does have such arrangements why was the
decision taken to extend the scheme in this way and what
arrangements are in place?
3. If your authority does not have such arrangements does your
authority have some other arrangement beyond the statuary minimum
to provide passes to those with mental health issues?
4. If your authority does not have such arrangements why was the
decision taken not to extend the scheme in this way and has
consideration been given to extending the scheme in this way in the
future?
5. Would it be possible to provide copies of any relevant policy
documents you may have.

For the attention of: Robert Eriksohn
I refer to your FOI enquiry of 29^th January 2009.
This Council is a member of the Cornwall Concessionary Fares Partnership
and it relies on the Cornwall County Council's responsibility within the
Partnership to administer and deliver the arrangements across Cornwall on
behalf of the six Cornish District Councils (The TCAs).
I have ascertained the following response to your questions from the
Cornwall County Council as a representative answer to the arrangements
applying within the Carrick area.
(1) The Cornwall Concessionary Fares Partnership does not recognise the
term "mental health user or survivor".
However, whatever its exact meaning, there are only two categories of
passholder entitlement that involve mental health. The first is the
learning disability category. In this case the Partnership interpretation
of "learning disability" is as the Department of Transport Guidance to
Local Authorities. The given definition of learning disability in the
guidance is "a state of arrested or incomplete development of mind which
includes significant impairment of intelligence and social functioning"
and, as a generality for all categories of entitlement, "which has a
substantial effect on a person's ability to carry out normal day to day
activities". The second category dealing with mental health is to do with
"people who would be refused a driving licence on medical grounds", one
category of which is a person "with a severe mental disorder" The
Partnership has no different local interpretation on entitlement.
(2) In the light of (1) above, this is not applicable.
(3) No.
(4) The Partnership has seen no compelling reason to cause them to deviate
from the Department of Transport definitions above. There are no plans to
do anything different for the future.
(5) As the policy is completely in line with Department of Transport
guidelines, there is no other policy document.
